Dropped Kerb Refusal

Hello to everyone,

I would appreciate if anyone can help me to proceed or any advice as to how i can appeal this.

I applied for a dropped kerb outside my property and received a refusal letter from the high ways officer with the following comment:

"The requirements for Sensitive and Local Distributor roads are that you need to be able to enter and exit the forecourt in a forward gear. In order to do this, the dimension of drive needs to be at least 12 metres by 10 metres

In the case of the above property, the dimensions of the forecourt do not meet the Council’s criteria.

For this reason the Highways Officer cannot consider your request for a vehicular crossover to this property"

It has been refused because they have deemed the road to be a classified ( Local distributor ), However my neighbour adjourning my property has their drive way approved 10 years ago and 2 other neighbours on the street also have drive way. I meet the minimum requirements as per the  council dropped kerb but I refused because of the above reason.

can anyone help or assist me with how I can appeal this or go about doing this and also if anyone has been successful in appealing the highway officers refusal.

    Try posting on the https://forums.moneysavingexpert.com/categories/in-my-home-includes-diy-moneysaving forum as posters on this forum have dealt with this type of issue before and it is not a parking issue.

    What other people have been allowed to do in the past doesn't matter - the council will assess your application based on their current criteria.

    Is your house on a classified (A/B/C numbered) road, or have they made a mistake?  You can check by looking for the "highways gazetteer" for your area, or possibly on the FixMyStreet website.

    That's the crux of the matter. They expect you to be able to turn around.
    I fell into this pit years ago and it's frustrating when all about you just have a car space.

    The irony was that where I asked was much safer than where I eneded up. Corner house I was able to exit onto a smaller road - right on a corner instead of a straight road but it was legal so they huffed and puffed but couldn't stop me.

    Could it be that you have more land where you could make a turning space? Needs to be to their standard though so don't go gung ho about it.
    As said, what classification of road is this entrance on?

    10 years ago the rules could have been different, any application is assessed against the rules that are currently in place.

    Either you need to prove they've made a mistake on the classification of your road or adjust your plans to meet their minimum requirement to allow a vehicle to turn so can drive forward on/off the driveway. 

    I know a chap who wanted to be able to drive on/off but didnt have space so installed a turntable, wasnt cheap! Dont know if the council would consider an alternative method of meeting the requirement like this?
