It's interesting that you say that...
It's not a question that's asked on the standard TA6 Seller's Property information Form
But in this case, the Buyer's Solicitor asked a number of further questions. One of those questions was:Has the property ever been affected by woodworm, dry rot or other timber infestation or decay; defects in drainage, water pipes, gas pipes or electrical wiring; damp; Subsidence, landslip or heave; any structural building or drainage defect; vermin infestation; asbestos
The seller answered...The Seller is not aware of any such matters...
And the court decided that moths were vermin, and the seller was aware the moth infestation.
(There were other aspects to the case as well.)
