    I am the keeper of the car. 
    So I should email them the first template to question them about the charges? Is that correct?
    And I just wait for their reply? How likely are they going to carry on with this… I really don’t want to go to court and all that…
    You will get a claim form.

    You will defend it easily. Use the template.

    You won't be going to court.
    The reason I’m worried is because I don’t know how to defend it.
    i was in the car park for about 40 minutes when the ANPR got my number plate and I didn’t get a pay and display ticket. The ticket machine you have to put in your number plate. I don’t know what I can say for them to consider me to have a valid reason…
    Luckily, their claims are so badly pleaded that you can use our template.

    Hi guys. Just thought I’d let you know that I chickened out and decided to pay the £170. 
    I have too much going on in my life at the moment and decided it would easier to just pay it this time.

     But thank you all for trying to help anyway.

    Hi there,

    I'm hoping someone can help me with the next stage in my claim.

    I've followed this thread because I've also had a letter of claim from DCB Legal so have followed the process above. The current status is:

    - I received the letter of claim
    - I responded with the suggested template above as the Registered Keeper
    - They have followed up with an email, details of which I've tried to share on here but apparently I haven't been around for long enough on the forum to share that detail.

    If there is another thread that provides the next steps to challenging this claim then please let me know and I'll follow that.

    Just trying again to post the content of the email I've received:

    We write in response to your correspondence received in our office dated 24/02/2025.

    We now respond to the same as follows.

    When parking on private land, the contractual terms of the site are set out on the signs. You are entering a contract and agreeing to the terms by parking and staying on the site. Parking in breach of the terms as stipulated on the signage means that you are then breaking the terms of the contract.

    The Parking Charge sum of £100.00 is for the breach in contract as displayed on the signage.

    Where a parking charge becomes overdue and before Court proceedings have commenced, a reasonable sum may be added for the debt recovery fees. The correct recovery fees have been added and will not be removed. As such, the outstanding balance of £170.00 remains payable to prevent further action. The HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), confirmed that parking charge falls out of the scope of VAT.

    The sum added is a contribution to the actual costs incurred by our Client as a result of your non-payment. Our Client’s employees have spent time and material attempting to recover the debt. This is not our Client’s usual business and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.  

    You now have 30 days from the date of this email to make payment of £170.00. Failure to make payment will result in a Claim being issued against you without any further reference.
