IVA Completion certificate delayed by 9 months
Options
Hi,
I wondered if anyone could offer any advice on whether I can take any action against my IVA practitioner.
I recently completed my IVA back in June 2024; it was extended by 2 months due to a bonus I received the previous year. Other than that, however, it ran perfectly with no other missed payments or extensions.
I hadn't received a response from CreditFix in November and so I chased this up with them several times before I got a call to let me know it was being investigated.
A few weeks later, they advised me that they were waiting on a response from a creditor, a guarantor loans company, to confirm they were happy with the settlements.
The issue is, however that the loan company were never included in the IVA, it was made specifically clear to me that as it was a guarantor loan that the guarantor would pay if I couldn't that they explicitly could not be included in my payments so this should have been clear to them the whole time.
I heard nothing back throughout January despite multiple attempts to chase this up and I only finally received my certificate yesterday (4th February 2025) and I have sent this off to the relevant credit companies and the insolvency service, they have told me my name will only now be removed from the register in May as my certificate says the IVA was completed yesterday and not June or (within 6 months of) 2024 so it looks like I took longer than the 5 years to complete and my credit file won't be cleared up for another few months.
Apologies for the long post but is there anything I can do about this as I did everything I needed to in terms of payment, reviews etc and now will have to wait even longer before I can apply for things like a mortgage?
