DCBL - what to expect next ?

Hi everyone. Just wanting to know what to expect next. 

I have recently received a debt collection letter from DCBL for a parking fine from 2019. This has come to my new address as I moved home shortly after the date on the letter. They used a tracing system, this is the first I’ve heard of it. 

I emailed both parking eye & DCBL to make them aware of my change of address. DCBL confirmed the change but parking eye sent this back : - 

Unfortunately, due to our data retention policy, and the time which has elapsed since the date of the parking event, we no longer hold any personal data in relation to this Parking Charge, and therefore we are unable to update our records with a new address

We would advise that you contact DCBL directly, to update the data which they may hold.

I have also been in contact with the land owner from the original fine who say they haven’t used parking eye for years. 


Just wondering what I can expect next ? Should I be preparing to fight this or just ignore the debt collector letters?

    What's the date of the parking event?

    Sounds like it's near to 6 years and being statute barred.

    Definitely ignore the powerless debt collectors letters 

    As long as you have updated both parties with your correct address for the service of papers,  sit tight

    Your main aim now is to get it past the 6 year deadline under the Limitations Act 1980, assuming that you are in England and Wales   ? (  5 years deadline in Scotland   )

    When is that deadline   ?

    It is not a fine.

    Debt collectors are powerless and can safely be ignored. Do not ignore a letter of/before claim or a court claim.

    You should send a rectification notice to the DPO of ParkingEye instructing them to erase your old address and replace it with your current address for service, which is not the same as just telling them you have moved.
    Irrespective of the response, keep it safe until six years have elapsed from the date of the alleged event if you live in England or Wales, or five years if you live on Scotland.

    Make sure you use the word I have highlighted as it has a specific meaning with regards to data protection,

    There was no "fine" only a speculative invoice, Parking Eye have handed the file to their tame debt collectors that have no powers, which is why they are possibly stating they hold no records, and it follows that if PE have left it so long they are not minded to take it to the small claims court for what ever reason.
    What was the date of the original event, I suspect the dimwits at DCBL are making a last ditch attempt to collect before it times out this year.

    You need confirmation that ParkingEye have erased your address.

    This reply assumes you are not in Scotland.

    Clearly - if the date in 2019 is quite late - you might have to get to a stage where you must deploy the tactic to respond slowly and ask questions / ask for evidence under the PAP, etc. Always on the last day given, or the day after.

    Covered in lots of threads.  What you DON'T do is respond too early saying you are seeking debt advice, because you need to hold that back as your final delaying tactic for DCB Legal later this year.

    Much depends upon the date of the parking event.

    Just checked the received letter from DCBL . 

    “Date of contravention 14/06/2019”

    I’m from England, I have emailed parking eye again to tell them to erase my address

    OK so as it is only with DCB Ltd at the moment you should wait for the next letter then begin the deliberate delaying tactics.  When you come back to show us the next letter, remind us that you need guidance on TIMING IT OUT PAST JUNE because the case is almost at the 6 year limitation.

    If you don't remind us, we'll wrongly tell you to ignore the next letter.  So please prompt us then.
