Confirmation & Title Deeds

Hi, first up thanks for all the useful information on this Forum that helped me successfully submit my late mum's estate for Confirmation through Edinburgh Sheriff Court, saving me over £3,000 in lawyers fees.

We have Confirmation and are now ready to sell my late mum's house. The lawyers we have engaged with have informed us that we need to alter the Confirmation to remove the reference to the Land Registry (it includes the Land Registry title number as I was advised to include it) using the C4 Corrective Inventory Account form and then submit it back to the Sheriff Court.

From what I can see on the HMRC website, the C4 should be used when there is a change to the value of an inventory item (there is no change to the house value at this stage) so I am unclear as to why we are being asked to do this.

Is there any reason why we need to make such a change before selling the house? TIA.

    In Scotland it is not 'Land Registry' it is 'Land Register'.

    Is it possible that you are being asked to change the description to the correct wording?

    Thanks buddy9 ... my mistake in typing the above, our C1 form correctly states "Land Register of Scotland" so that is not the issue.

    The C4(S) can be used to correct description errors.

    I think you need to find out from the solicitor what exactly you need to change and why.

    It is difficult to see why a title number would need to be removed, unless it was in some way incorrect.

    As an afterthought. Was the house definately in the Land Register and not in the general register of sasines?

    That is a very good shout - they are in the General Register of Sasines. I will follow up back with the lawyer to clarify for sure ... they are going to charge us £1,000 to make the change so that will not be happening if it still needs to be done as I will do it myself.
