Luton Retail Park PCN

Good day all.
I posted this on another website, but seeking more insight.
I overstayed a free parking period (3hrs) by 32 minutes - 1945hrs to 0015hrs and received a PCN from GroupNexus.
Having reviewed POFA, it indicates that "the creditor will..... have the right to recover from the keeper so much of that amount as remains unpaid)
Having looked through POFA Sched 4 and the GroupNexus letter, I can't see anything that would indicate their letter not fulfilling POFA.
Should I pay their 'demand' or is there something I have missed?

Definitely don't pay them
Plan A in the newbies sticky thread in announcements is certainly something you missed, complaining about the PCN to the retail park management company or landowner ASAP
Are you sure that the NTK PCN letter complies with POFA ?

What you've missed is:
- nobody has to pay Group Nexus;
- don't pay. That's funding a rogue industry;
- ignore it because these are easier to dispute at court claim stage. Especially at Luton court! Very good court.
- REALLY try Plan A to get it cancelled. We assume you must have read NEWBIES PLEASE READ THESE FAQS FIRST before posting & have read about 'Plan A'.That's it. See my signature if new to navigating this forum. We won't link the sticky thread.

Yep - I have emailed the owners of the retail park - though not had a reply yet. I may try and find a phone number for them. I also spoke with the manager of one of the stores there. He said there was nothing he could do and also said some other customers buying a kitchen were in the same position and the store wasnt able to help.

Also PoFA the creditor can claim from the keeper if they are not informed who the driver was. Sched 4 Paragraph 9(2)(f)

I also note that there is no mention in their letter on the duration of free parking that was available. It just states 'maximum stay'.

I'll call the head office of one of the stores at the retail park. I may get some headway there. However, it would seem to me that the stores will have little strength in this matter - the PPC will have a contract with the retail park, and not the stores within it?

Yes - trawling through Newbies threads! I had experience with APCOA in 2017....so I know my way around PoFA...even though it has been updated since then

Are you sure the retail park allows 3 hours when the stores are shut? Usually it's 10 minutes after hours.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I will have to revisit to check the signage. I took a photo, but the detail was not great.
There is a McDonalds open late in the retail park. All others close 2000hrs0 -

My NTK pictures thread already shows you that Group Nexus NTKs are generally POFA compliant these days.
No worries but just to clarify that angle.
Getting some good photos now will be useful in case of a court claim later, especially showing a LACK of GN signs near the McDonalds and around those bays and dark corners.
Go in hours of darkness. Not earlier than 9pm.
And look at the ENTRANCE for the retail park property agents contact details. It'll be there on an entrance plinth/store advertising welcome sign. That's who to complain to.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
