PIP award

Options
My daughter had her PIP stopped in November 2023, she had her tribunal heard on 16th Dec 2024 and was awarded the high rate for both parts, backdated to March 2023. 3 weeks ago I spoke, on my daughters behalf, to PIP, as it had been a few weeks and we had not heard anything. The lady on the phone stated, they needed to clarify a few detail with her and that it would take around 2 weeks.
Today my daughter received a letter from PIP, stating they could not pay her has there is an error on the paperwork from the tribunal, this being, documents have my daughter and someone else's name on it and it now has to go back to the judge.
I find it a bit odd that it has taken almost 8 weeks to discover an error. The letter states it could take another 6 weeks plus before she hears anything. Is it me or is this ridiculous?
Is there anything else I can do?

It's not ridiculous to feel as you do, but errors do occur, particularly when the courts are stretched as they are.

I would suggest that she (or you, if you are her appointee) writes back asking them to try to expedite the payment to her, and point out that she has been without a PIP payment that the court has said she is entitled to since March 2023. I think I would make the points that it took 8 weeks to discover the error and that it is coming upto 2 years since she was eligible for PIP!

I would suggest that she asks them not to reply unless it is decided that they cannot pay PIP at all, but emphasise your trust that they will do whatever can be done to put PIP into payment for her. (There is no point requiring an answer that will be vague and non-comittal). Suggesting you trust them to do the best they can (even if you doubt they will) is the best way to encourage them to try to do the right  thing.

You can complain about the HMCTS service, if it turns out that they were the cause of the error, but your daughter will receive PIP backdated to March 2023, so I doubt they would make any sort of payment in compensation, but might send an apology.
The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.

It's possible PIP was at the lower award and the form was sent in in Mar 23. When assessment happened  they completely took PIP away.
The Tribunal awarded the high rate for both when the form was completed, OP would then be due the difference in rates between Mar-Nov 23 plus the full PIP from Nov 23

  • Thank you for the responses.
It is correct that my daughter was on lower rate for mobility, which was changed by the tribunal court, to high rate to be backdated to March 2023.

I sent an email to the clerk at the tribunal court, explaining what had happened and if there was anything that could be done earlier than 6 weeks plus. I received a reply stating that she had forwarded the email to the judge, which I felt was very good of her.

As advised above I will contact PIP, also.
