N180 Form

Hi 4 years ago I drove into a Euro car park in the pouring phone ran out of charge so drove out again a few minutes later. In November my daughter received a claim against her so I filled out the defence form for her on the MCOL following the advice on this forum. I have now realised that the Form N180 was due on 31st Jan I’m quite stressed. Please can someone help me to fill in the form or is it too late to send it in. Many thanks

It's self explanatory just fill out as best you can online email it over.
    No biggie
  • Thank you for replying so quickly. I only appear to have been sent the form in paper format so will post it off in the morning.

No, dont do that,  download a vanilla N180 pdf copy from the gov website instead

Fill it in,  as per post 2 in the newbies sticky thread in announcements plus check the 12 steps in the defence template thread too, fir guidance

Email it when complete to the DQ email address at the CNBC in Northampton

Also CC a copy to the lawyers too

There is no need to post anything at all,  email only
  • Thanks just doing that now. Can I put my name in as the contact details or does it have to be my daughters details as the claim is in her name. (Apologies for so many questions)

Everything must be done in the name of the named Defendant.
  • Thank you I am very grateful for all the help.

It’s so unfair and I want to fight this as I didn’t  even park in the car park only drove on and then back out again but also very stressful thinking my daughter may have to go to court.

Its unlikely to get to a court hearing,  if both of you follow the advice here

There are over 470 discontinuations in the tally thread by Umkomaas,  I doubt that hers will be any different  !

The system has been unfair for about 15 years or more,  the government brought in a new bill,  new law 6 years ago,  still awaiting implementation of a mandatory Code of Practice

But from four years ago until the Claim Form was issued your daughter had every opportunity to name the driver.
    Apparently that didn't happen.

Euro Car Parks will have asked your daughter for the driver's details more than once.
  • Yes I realise that now but the information I was reading said not to identify the driver.

But the caveat to that is that the keeper is willing to take it on, all the way to a court claim,  if necessary , especially with companies that are invoking POFA 2012

Which is the current position in this case ( never assume that nothing will happen  )
