Redundancy

I got made redundant with my contract terminating on the 24th January 2025,I got 20k and was told it would be paid on February 27th 2025,this is in a letter from the company.4 days later I had a call offering me my job back which i accepted verbally,from my point of view there were 4 days where I wasn't employed  so I should be due a fresh contract when I start on the 3rd February 2025 and the 20k redundancy to still be paid on the 27th.

  • I can't see that happening and the company will see it as continuous employment,so looking for some advice.I have spoken to ACAS and they are on my side but I do know the company are just expecting me to go back yo work as if nothing has happened.

    There should have been some documentation about the redundancy payment when you left on the 24th.  

    It is fairly standard that if a company rehires someone within a short period (possibly 6 months or a year) that the redundancy money would need to repaid.  So, no, I don't think you'll be getting £20k on the 27th.

    So you need to think about what you actually want.  £20k in a bank and no job.  Or ongoing employment.  

    If you want the ongoing employment I would suggest you ask that your redundancy be rescinded so that there is no break in employment.  Then you might negotiate if you get paid for the missing 4 days or if it's taken as unpaid leave.  What you don't want is for them to decide they don't want you several months down the line and say a simple "goodbye" without a payout because you've been working there for less than 2 years.

    you  aren't going ot get a payout , you  would be  better off negotiating that your service is considered unbroken due to the less than a week away

    you really don;t want this to be a new  period of employment  with the company ...

    ACAS are technically correct. You need to have a full and frank discussion.
