POPLA appeal for when we got trapped in car park gridlock and didn't park

On Boxing Day we tried to park in North Greenwich Main Car Park (for O2) but there were no spaces and it was complete gridlock so we could not escape. We then got a letter from Saba with a fine. We've appealed (including proof of paying £40 to park at official O2 car park at same time) but had it rejected.

We are now doing POPLA - if someone could check if it looks alright that would be amazing please. We had to confirm the driver in order to press submit on the Saba appeal, which I now realise we maybe shouldn't have done!

I am writing to formally appeal the Parking Charge Notice issued for my vehicle on 26 December

at North Greenwich Main Car Park. The charge is unwarranted for the following reasons:

1. I Did Not Park or Leave My Vehicle

On the date in question, I entered the North Greenwich Main Car Park but was unable to find a

parking space due to extreme congestion and gridlock. The car park was overcrowded, with

vehicles unable to move, and many people walking around attempting to navigate the situation.

At no point did I park my vehicle, exit the car, or occupy a space. I attempted to leave the car

park as soon as I could, but it was impossible to do so quickly due to the volume of traffic.

2. Proof of Alternative Parking

After leaving the North Greenwich Main Car Park, I parked my vehicle in the Official O2 Area

Car Park, where I paid a charge of £40. Attached, you will find my bank statement

showing this payment. This corroborates that my

vehicle was parked elsewhere at the time, and I did not park in North Greenwich Main Car Park.

3. Exceptional Circumstances

Boxing Day is a uniquely busy time, and the reduced public transport services likely contributed

to the overcrowding of your car park. Furthermore, a major event was taking

place at the O2 Arena that day, significantly increasing traffic in the area. Proof of this event is

attached for your reference.

Is it a Penalty Notice or a Parking Charge Notice   ?  Your proposed appeal states the latter

I don't recommend you try POPLA. Why are you?  Because they told you that was your only option? They lied.

Why aren't you just ignoring useless SABA?

It says Notice of Parking Charge at the top.

So was it a byelaw contravention,  or a contractual one   ?

Clearly they are obfuscating by mixing up the words,  a bit like Eric Morecambe and Andre Previn !

Popla are not going to uphold any appeal
