Town Quay Southampton Parking Eye


I have unsuccessfully appealed against a pcn from Parking Eye when my husband drove into Town Quay Southampton in November 24, and failed to realise the parking requirements Parking Eye. He received a PCN and I appealed as per the information provided by Jason R and submitted the 8 point appeal duly personalised without, of course, identifying who was the driver. PE have rejected the appeal and I now have a POPLA number to appeal. My question is do I simply state the fact of Town Quay being non-relevant land or do I reiterate the 8 separate points again - just wanted to check before submitting the appeal to POPLA. Thanks for your help and direction.

- not relevant land (you'd have to prove it with an official byelaws map AND a quote from the Port Byelaws proving that they do include reference to vehicles/parking) because I suspect the NTK has used POFA words on the back;
- unclear signs
- no landowner authorityPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hurray and huge thanks to you lovely people - just had this back from Popla regarding my appeal.....
Dear Mr Foulkes,
The operator has contacted us and told us that they have withdrawn your appeal.
If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.
If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.

Just for reference I appealed as per the three points which coupon-mad recommended - have tried to attach the document for others to reference...but get message saying format unsupported

PE know they're skewered when POPLA appellants cite no keeper liability at Southampton Town Quays, it being 'non relevant land' under PoFA. Well done on seeing them off.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
