How to take legal action through the Small Claims Court against Ebay seller?

    Then what? I can’t see what you are hoping to achieve except to cost yourself more money. 

    Look again at the seller’s listing, you need to double check in case they are a business and therefore have their details showing, including a geographic address. Every single selelr shows whether they are a business or a private seller.

    What are you proving though? Ebay don't have your money, the seller does.

    Success - After numerous rejections from Ebay I have got my money back - it is very difficult dealing with Ebay Customer Services because as far as they are concerned asking for a return because it was the wrong size does not comply with their procedures but I argued that under UK legislation if the description was wrong then it did not comply with the law.
    As stated previously I copied my complaint to my local authority who informed me that they could not do anything as Ebay had agreed on a lead authority process but that they would pass it on to see if they could help and within 2 days I had the Ebay Executive on the phone who have agreed to pay the full cost.

    It sounds like you asked for a "Return" when you should have opened a "Not as Described" case. Two different things in eBay land.

    Glad you got it sorted. As I probably said elsewhere in the thread it's a pain in the bum to go through all that but it's still the quickest way to get your money back. If you'd have gone to small claims you'd already be more out of pocket and still not seen any money back and possibly waiting several months to get anywhere.
