NPC - Myrtle Parade

Hi All,

Looking for some help. My wife parked in the NPC car park on Myrtle Parade Liverpool. She did pay but due to poor signal and the ringo app being useless by the time she had paid she was out of the allowed window (15 minutes I think). She appeals to NPC (and admitted being the driver) before she told me. They obviously rejected this and sent a NTK. 

I have contacted the Landowner as per the Newbies thread but don't seem to be getting anywhere (unsurprisingly). 

Would my next step be to complain again to NPC using the general letter on the thread or is that too late now that she has had a declined appeal? or just wait (beyond the debt collectors) until the letter from the legal company arrives?

    Some MPs are calling for statutory regulation for the private parking industry as voluntary measures and industry's new code are failing to protect and treat motorists fairly.

    Make sure your MP is aware. It's easy to email using Smoof's template letter just copy/adapt for you.

    They'd never win in court. You paid for your time.

    It might be different if this was a site with tickets issued to windscreens.  But I doubt it is. Even in those sites, a PCN would be unfair if the motorist was in the process of paying with the operator's slow, unreliable systems.

    There should be no possibility of PCN issuance later by post, if the motorist has paid during the time car is parked (or pays retrospectively at sites where that is offered for a limited time after leaving).

    Sit tight. I think NPC use DCB Legal, which is great because they almost always discontinue.  Even if it went to a hearing, the Judge would say you paid as soon as possible, so there's no cause of action.

    Search the forum for HHJ Pema to see his judgment; a refusal to let an appeal progress in a case where the motorist paid, so there was no loss.

    To CM's point, NPC do use DCB Legal, you'll get the standard 3 letters from DCBL, then a letter before claim from DCB Legal - nothing to worry about, they're standard template letters, and as CM states this will not win in court.

    Do also read the other threads (so you know you're not alone at this site) about Myrtle Parade - search those words

    Can you please help (and apologies if I am repeating questions from elsewhere in this website!)

    My car was parked (not by me) in a small private car park at 2316hrs at night for around 20mins to pick up a disabled friend and received a 'PCN' from National Parking Control Group. There were no others cars around but there was a NPC sign (not huge, and not noticed) and cameras obviously.  I appealed to NPC (not stating who the driver was) but this was rejected.  I then received a Notice of Debt Recovery from DCBL and now a Final reminder from DCBL (for the charge which is now £170.00).   This all seems very disproportionate and unfair, as well as the receipt of threatening letters.   I don't want to pay of course but if was unlucky enough for them to take this further, how would this turn out in court?  How likely are they to take it to court?  Should I send another letter to NPC with particular wording on it.     Thank you SO SO much in advance for all of your helpful advice.
