DCB Legal offered a settlement

Good Morning and thanks in advance for any help.

Cut along story short I have two parking tickets while attending a gym where the machine wasn't working. (have no evidence of this but do have evidence I was at the gym)

I have followed the newbie thread up to now, i.e. ignoring all letters, responding to letter of claim with the template and have received the following.

first in Italics is my response to letter of claim, then the DCB legal.

Should I try and get a further reduction or pursue to court

I refer to your letter of claim.

3. Reason for disputing, I have evidence from the gym where I was parking that I was present in the gym and on both occasions the machines were unplugged / damaged so I was unable to enter my registration.

I have email proof from the gym manager regarding this and request that you discontinue with proceedings and cancel the case on this basis.

Please let me know how you wish to continue

We write in response to your correspondence received in our office dated 21/01/2025. 

We now respond to the same as follows. 

WITHOUT PREJUDICE 

We acknowledge your points raised and evidence provided, however, it is our Clients’ position that the Parking Charge was issued correctly, the vehicle was parked over the notified maximum free parking period of 2 hours. If the terms of parking required you to enter your vehicle registration to validate your extended stay, but there was a fault with the machine, there would have been a telephone number displayed on the machine itself for you to report the fault and validate your parking session. If it was not possible for you to validate your parking session, then you ought to have sought alternative parking elsewhere to avoid the Parking Charge from being issued.  

When parking on private land you are entering a contract and agreeing to the terms by parking and staying on the site. Parking in breach of the terms as stipulated on the signage means that you are then breaking the terms of the contract and agreeing to then pay for the relevant breach. An instruction provided from a third party does not supersede the terms of parking.  

In order to bring this matter to a close before the matter progresses to the next stage, we confirm that our Client would be agreeable to a payment of £200.00 in full and final settlement of this Claim. The current outstanding balance is £340.00 

You now have 30 days from the date of this email to make payment of £200.00. Failure to make payment will result in a Claim being issued against you without any further reference.

    should i wait till they send a court form then? I'm not sure my defence of, I have proof I was at the gym, will suffice?

    Your defence is based on the defence template and recent tweaks as seen in other recent threads here,  with advice from here too

    Your account is your later Witness Statement plus Exhibits like your proof,  which is later on in the process
