    Not sure what you mean? I just got the LBCCC so now I assume that I need to acknowledge the receipt and ask them for missing info - as per instructions on this forum. 
    Should I not ask here (my thread) for help?

    Dear Sir/Madam,

    I acknowledge the receipt of your Letter Before County Court Claim, dated [insert date], relating to the parking charge for [vehicle registration] at xxx

    Upon review, I note that your LBA does not comply with the Practice Direction on Pre-Action Conduct (PD) under the Civil Procedure Rules, and, in addition, it is also misleading. 

    You are required to provide A FULLY COMPLIANT LBA with the missing information before initiating court proceedings. Please explain your legal standing to bring these proceedings, providing copies of any documents that you propose to rely on.

     

    1)      Please specify which terms of contract were breached as the details of your claim are not clear, your letter does not specify the legal basis of the claim.

    2)      Please explain what specific signage was violated to provide the clear summary of the facts.

    3)      Please provide the breakdown of how your demand of £125 (£100 + £25 recovery fee) was calculated and justified. Please:

    -          state how this charge has arisen

    -          quantify how the charge has been calculated – include a breakdown of the claimed amount

    -          please identify and quantify any loss claimed

    4)      Please provide the essential documents – particularly the copies of:

    -          the contract between the Parking Eye and the landowner authorising you to issue PCNs.

    -          clear photographic evidence of the parking terms and conditions as well as signage at the car park and proof that it was visible at the time of the alleged breach

    -          proof that the payment machines were working correctly at the time of the incident

    5)      Your letter doesn’t properly explain any further ADR options or whether mediation is possible before court action. Please confirm that you are willing to engage in Alternative Dispute Resolution or mediation before court action.


    Your letter does not invite me to request missing documents I may need to assess the claim which is just another example of it being non-compliant with the Pre-Action Conduct Practice Direction. Just like your letter claims this compliance but does not actually meet its requirements, which is therefore misleading.

    Failure to provide the information above may result in the court penalizing you for non-compliance with the Practice Direction, should you proceed with a claim.

    I await your response within 14 days. If I do not receive a satisfactory reply, I will report your conduct to the relevant regulatory bodies and prepare my defence accordingly.

    She hasn't posted here for years.  How on earth did you find that ancient thread? Forget it, as I said. Did you not notice the dates on those posts?

    Maybe somebody on here could help me please - I just got the LBCCC from Parkingeye. I looked at another advice on this forum but apparently it is out of date - and a letter I've been working on all day is apparently useless. 

    Would ANYBODY be so kind and share the most up to date link with me (the actual link?) - to anything that would tell me what to do with my LBCCC now? I posted on my own thread but apparently it's all rubbish - but the whole history of my case is on there (POPLA rejected my appeal, the parking machine was faulty and said PAYMENT APPROVED but it wasn't, I complained to the land owner but got ignored).

    Today I got a LBCCC from Parkingeye and based on the information on this forum I spent the whole day working on my acknowledgment letter only to find out that what I've done is useless because apparently the information I used was OLD.

    That's why I need the most up-to-date info please. Fingers crossed this will also help other people in the same situation as mine.

    Just a bit of a background info: I complained to the land owner twice and got ignored, my POPLA appeal got rejected. I thought I paid for parking BECAUSE the parking machine was displaying PAYMENT APPROVED on its screen (and I have a photo of that). But I also got a void receipt that looked like a normal receipt - all looked normal, typical receipt, nothing unusual, so I thought it was paid - and this was the reason I got the parking charge and only then I realised the receipt had that tiny print saying 'void'. Both things were just MISLEADING!

    So apparently all the info I now need is on the NEWBIES thread - post 2. I had a look and it's not really clear - so just to double check, if you don't mind:

    1) Do I ignore Practice Direction on Pre-Action Conduct (PD) under the Civil Procedure Rules and don't ask Parking Eye for any missing documents? I checked with Chat GPT and it has confirmed that their letter is not compliant with the above rules - so should I not use that at all/does it not matter? Do I not acknowledge the receipt of LBCCC within the 14 days? DO I just basically ignore all information provided by @zzzLazyDaisy - I thought her advice seemed really good! Why isn't it no longer good? I think the PD is still valid??


    Re: newbies thread post 2 - In my case they already know the driver's name - I've been transparent and honest from the beginning.

    3) DO YOU HAVE ANY EXAMPLES OF EMAILS SENT TO ENFORCEMENT AT PARKING EYE THAT COULD HELP ME WRITE MINE PLEASE? Instead of directing me to Newbies post 2 again...

    4) I then send that email and wait for the court claim, right?

    5) when I get the court claim - I search the forum again to find the Template Defence.

    NEWBIES thread post 2 doesn't provide enough info - so any help will be MUCH appreciated, thanks so much for all your much needed help.

    @Coupon-mad - Newbies thread post 2 doesn't provide a specific answer. According to your advice I now need to email parking eye's enforcement team, right? Could you share ANY EXAMPLES of such email to the Parking Eye?

    I now need to come up with my own answer as there is no template provided - and you say I shouldn't post it on here??? So does that mean that I can't ask for help - for someone else to look at it before I send it?

    In the NEWBIES thread post 2 you mentioned yourself that Parking Eye are a little different - and in my case they know the driver's name and address!

    Jolly good. You want them to know your name & address and it's fine you were driving.

    I explain there in the newbies thread that you just treat it like an appeal/final dispute and email them. No need for a template; you know your case is about a void receipt that breaches the current Code.

    Keep it concise though!
