NHBC claim - Kitchen extractor/ducting

My house is still just within the 10 year NHBC warranty. It is one of 12 houses all built in 2016. The kitchen extractor fans have all failed in my house and my neighbours' houses. Having investigated I have found that my extractor fan discharges into rigid ducting that appears to be connected with the downstairs loo instead of (as I would expect) ducting to the outside. I cannot see that this can possibly be building regs compliant. The downstairs loo is internal (no windows) and has its own air circulating extractor fan.

The NHBC wording says that ventilation ducting is covered but a claim must meet the minimum value and I must be able to demonstrate that the defect has caused 'damage'. Clearly poor ventilation is a health issue causing poor air quality, build up of damp, smoke and cooking residues on surfaces etc.

Has anyone successfully claimed for this type of defect? The resolution will require the kitchen ceiling to be taken down to retrospectively ok install ducting and a vent to the outside wall which will be quite disruptive.

Any advice much appreciated.
