    The Card debt had an element of PPI on it which is why I was refunded PPI, So for exmaple maybe £300 of the 4K was PPI, which means the case they took me to court for in 2001 was incorrect as the PPI was misold and misapplied. 

    Does this not make the case , the outcome and charge against my property null and void?
    Unfortunately, it does not. And they will not negotiate as they have the full amount secured by means of a charge on your property.  Clearing the debt is the only way to remove it and if you have had a refund of the PPI the you have the means to clear it. Even if you could challenge it, it would likely cost you more in fees and legal costs than it would just to settle what you owe.

    If you had cleared the credit card, less the amount of PPI, you may have had a case for saying the charge on your home was unfair. Given that you didn't pay the amount owing on your credit card, it is reasonable for it to remain a charge on your property. 

    Your PPI miss-selling payment gives you a number of options. You could use it to clear the charge and get it removed from your deeds. Or you could keep the money and wait until you sell before clearing it. Check the wording of the charge to see if it accrues interest.

    Hi, it does not accrue interest, and in my negotiations with LINK I am not getting them to reduce to a reasonable amount.

    I have since this thread sent a CCA request to see my agreement, they replied within 12 days to say they do not have it but are within thier rights to chase me for monies.

    Is there any other thing I can do here other than pay them a large % they want?

    I don't have to pay until I move which is in the future

    If it is not incurring interest then inflation reduces its real value each year so you could just leave it until you sell the house at which point it will be repaid

    not necessarily - I would normally have said the same but I used to work for another lender and they never deducted debt from a ppi payout

    worth looking into - crazy but true
