APCOA Park Charge Notice Appeal Advise

I have read all of the newbies thread, tens of other threads, and all related information to my case that I could find here.

The vehicle I may/may not be a registered keeper for was recently served up a PCN by Apcoa, the alleged offense occured on a Universities grounds. With alleged photos being taken of the vehicle I may/may not be a registered keeper for most likely being taken through ANPR at the entrance to the university, these photos show just the plate and some headlights, as they were taken at nightime, with the operator of the vehicle not being visible at all. The first taken upon entrance, the second taken upon exit the next day allegedly. I am simply looking for advise on how to aproach this alleged incident and if the following appeal would be strong, particularly if the edited/added parts aid this appeal(i have used a lot of MCE advise/wording to craft this) Alongside this i am unsure on legilsation regarding universities and if this changes anything.

"Subject: Parking Charge Notice Appeal - [Insert reference number]
Dear apcoa parking ltd,

I dispute your parking charge as the registered keeper of the vehicle. I deny any liability or contractual agreement, and will be making a formal complain to your client, [insert university], about your predatory conduct.

No admissions will be made as to the indentity of the driver, and no assumptions can be drawn. Since you are relying on Schedule 4 of the protection of freedoms act 2012(PoFA), i require you to demonstrate full compliance with its requirements to transfer liability to the keeper.

Your notice to keeper is vague and fails to clearly explain the nature of the allegation. To properly consider your claim, i require the following:

Evidence of the allegation; A full explanation of the alleged breach, including the timeline and supporting evidence. I require proof of the exact location the vehicle was parked during this time and whether APCOA's terms and conditions applied to the location. If the vehicle was parked in a location not covered by your enforcement authority, this charge is not enforceable.

Copies of all ANPR images; including the entry and exit timestamps and confirmation that these accurately reflect the vehicles continuous presence on the relevant land.

Evidence of the grace period(s) allowed under the BPA/IPC code of practice and by the landowner and that they were correctly applied in this case.

Signage compliance; A close-up photograph of the signage present at the location on the date in question.

Evidence that the signage complies with the BPA/IPC code of practice, including proof that it is visible, legible, and prominent at the time (particularly in the dark).

Contractual authority; a copy of your contract with the landowner, demonstrating that you have the authority to issue and enforce PCNs on this land.

If the allegation concerns a pay & display (PDT) machine i require: A copy of the PDT payment records for the alleged date, showing partial VRNs and an explaination of why a payment is claimed to be missing.

If the allegation involves parking in a restricted area, provide clear evidence that the vehicle was parked in such an area, along with photographs of the location and the locations signage in which this vehicle was allegedly parked.

Without clear evidence of a breach of terms, a valid contract with the landowner, and compliance with PoFA, you cannot hold me liable for this charge. I request that this PCN be cancelled immediately.

Yours sincerely,
[Insert Name]"

Thank you so much for your time, I have huge respect for everybody assisting people here and I hope this alleged situation is not too much trouble.

Use this instead for this one

This is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

Thank you so much for the prompt reply, will this simply by itself resolve the alleged situation, or should I add anything else at all? - Also assuming i should include, name, reference number etc when appealing.

Hope you are having a great evening!

Add the latter, not the backstories,  keep it simple,  appealing as keeper,  no blabbing about who was driving

Thank you so much, is it fine to appeal online through their website, its asking for name, email & adress and wont let me move on wihout providing. Assuming this is fine and will have no impact, alternatively(but not preferably) i could appeal via post.

Of course it's OK! They already have the keeper's name & address.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Do as above, all that round the houses stuff you wrote won't be read and will just confuse them if they bothered to read it they will just come back with more rubbish, they aren't the brightest bunch.
The wording given above is known to them as coming from here and they will know they have been rumbled.
Please note that no "offence" has been committed and you won't see it written on any of their invoices.

Not sure if new thread is necessary as my question is very similar.

I mistakenly thought a car park (run by APCOA) was pay on the way out at the barriers (like some airports). But it was one of those pay by phone operations. I genuinely didn't see the signs till leaving as I was parked right at the back where I don't think there were any (beach side car park - not a normal town centre thing).

The car park was at the beauty spot in Wales, Ynys Llandwyn. I was perfectly happy to pay for parking it was just a mistake. I am not prepared to pay a fine of £60 for a genuine error.

Please advise if I can use the same message as above to have the ticket cancelled.

Many thanks to anyone who can advise, it's really greatly appreciated!!!!

Try It and see, no blabbing about who was driving, it may be cancelled, or not

    But

Yes you should start your own new thread

There is no fine, just an invoice from a private parking company, Apcoa
