doc1985 said:Just had a letter to say that the original creditor is unable to comply with the 12 day rule so currently enforceable. They sent my postal order back saying you no longer need to do that. Think thats it and i wont hear from them again?
It also mentions a default, they cant update my credit file with this can they?
The original creditor has to look through their archive to find your paperwork, or a digital copy of it, this takes time.
If they find it, they should pass it on to you, if they don`t they may just ignore you are continue to push for payment.
See what happens, its unenforceable until they do respond, however long that may be.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi,I sent a CCA 13 months ago to Cabot, to this day they haven't sent it. I ignore all their communication, letters & emails. They keep on threatening me with house visits etc, even their emails at the bottom of the page states this debt is unenforceable. My debt is from 2007, but I was paying a token amount each month until they started to harass me for more, then sent for a CCA.To be honest, I'm expecting the CCA....I'm sure they will dig it up...somehow.0

My gut instinct isnt worth more than yours, but my feeling is that a debt collector who is being very pushy probably doesnt expect the CCA will turn up!1 -
The CCA has turned up today!! Gutted. The main issue i have now is we have just saved up the money for a deposit on a mortgage. Im obviously going to have to start paying these now, will a mortgage company accept our application with payments to debt collection agencies on my bank statements 😞0

Any chance that a relative could make (and pay so its not on your bank statements) a settlement offer for you? how large is the balance?0

You haven't got to start paying just because they found the cca.
The only thing you need to respond to, ahead of a court claim, is a pre action letter, the sort that comes with a standard reply form and 30-day limit1 -
Agree with fatbelly, they can send all the threat letters they want, provide CCA`s, ring you five times a week, but the only thing you should take any notice of is an "LBA" (Letter before action) if they ever send you one.
