I received a PCN from MET Parking for overstaying and not paying for parking at Starbucks Stansted. I replied to them using this template I found in MSE forum and I got a reply. Below are the template I used and the reply I received from MET Parking. 

My Appeal

- I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

The claim will end up discontinued before the hearing date later this year.

So just use the Template Defence and put in your 'facts' paragraph 3 this:

Liability is denied and there has been no evidence of any overstay. The Particulars of Claim ('POC') misleadingly suggest that the registered keeper is liable when the statutory conditions required to establish such liability do not exist at this location. Stansted is subject to Airport Byelaws which include this part of the site. As such, this land is under statutory control and is not 'relevant land' under Schedule 4 of the POFA 2012. Registered keepers cannot be held liable at this location despite the attempt in the POC to mislead the court by citing a law that the Claimants and their parking specialist legal representatives know or should know, can never apply at Stansted. Further, the Notice to Keeper in this case does not attempt to rely on the POFA anyway, so the Claimant is well aware of the position and the untruth in the POC.

Nope but I did slightly amend the wording of some paras of the Template defence last night so use the new version plus what I gave you as para 3.
