My new shoes are falling apart (delivery on the 6th)

I ordered a pair of
1 PH8704 Quiksilver Men's Kettle Tie Shoes SZE 9 Delivery by 6pm fri

from https://www.discount2door.com and the bottom of the soles are falling off already. They look abit unsightly from the back. I'm aware I've been using them for two weeks now and I'm beyond their refund period but I wondered what my rights are?

I know this is wear and tear, but for the shoes to start falling apart in just two weeks is completely unacceptable as they cost £32! :(

    Your within your rights to return them because they are faulty, not because you have just changed your mind. They werent built well enough to withstand normal wear and tear, so definately return them.

    You'll never believe this.

    The other shoes that I ordered with this order were being delayed because of a stock problem and they sent me a letter on about the 20th to this effect.

    I just recieved a letter today to tell me that they've sold out and to accept their apologies.

    Almost a month and a half delay between placing the order and them telling me the product is out of stock. No compensation for my time offered but I wasn't expecting that anyway, however, some people would expect something...

    I think this comes under the 'not fit for purpose'. I had this happen to me a while back on a pair of training shoes (about 3 months old) .. the shop replaced them no problem whatsoever. I could be wrong here but I think you should also be able to reclaim any P&P costs incurred when items are not 'fit for purpose' (sometimes these are not refundable).

    I didn't reclaim postage and packaging but they recently refunded £32 for the cost of the shoes to my card, but you won't beleive what I just recieved through my door.

    I am afraid however, that these goods have been recieved outside of the Approval guarantee period.

    As stated in your catalogue, we do reserve the right to make a charge for goods returned outside of this period and the above charge has now been added to your balance. This charge represents the additional costs we have incurred as a result of handling of the late returns. Details of this charge will be shown on your next statement :rotfl:

    To avoid any further charges being made for late returns please ensure that you send any unwanted items back to us within the 14 day home approval period.

    In future we may return to you any goods recieved to us outside of the Approval guarantee period.

    They're trying to charge me £4.95 because I returned the goods under the sale of goods ACt. Bloody cheek.
