Trace debt recovery letter before CCJ

Hello Experts,
I had received letter from Trace Debt recovery Oct 24 saying I owed £170 to UKCPS from 2022 now Trace have been appointed collections.

From the advise here I ignored Trace letter as it didn't provide any details whatsoever and I have no recollection of any offence from UKCPS.

Last week I received letter saying last chance before they proceed with CCJ etc.

Please can someone re-affirm I should still not engage with Trace and wait if they are following through with CCJ and wait for PoC?

Many thanks

Trace are powerless,  they cannot sue you,  so ignore them,  post 4 in the newbies sticky thread in announcements

Ensure that your V5c is up to date

If you have moved since the incident date,  ensure that the DPO at  UKCPS  has your correct address for the service of papers

UKCPS can definitely sue,  even if its via a legal company like Moorside Legal,  or similar

What you are actually waiting for is a Letter of Claim followed by a court claim pack from the CNBC in Northampton using MCOL

There was no "offence" a company alleges you broke a contract with them that you agreed to but didn't pay.
Trace are so called debt collectors on a no win no fee contract to bully you into paying and prevent a possible court claim, they cannot issue a court claim them selves and I'm sure if you read their hamster cage bedding more closely you will see they didn't threaten following through with a CCJ only a judge can do that,

What worries me is why after over 2years they are asking? Nothing prior and I am suppose to remember each and every parking spot who was the provider? Hopeless..

Would be interesting anyone has experience if they actually follow thought and issue Letter of Claim via their solicitor ? or is it just the last try from them?

    Thanks in anticipation

It all went quiet from ukcps and then these letters from trace started, about 3 or 4, recently

So I gather these can be safely ignored and that the only concern is if there's letters from Moorside Legal, or similar Or a Letter of Claim followed by a court claim pack from the CNBC in Northampton.

My concerns. What happens if these latter two arrive, could you successfully appeal this or if need be bottle it and pay the crooks, or is it too late then? Ie could you settle before court?

Also, do we know if ukcps have ever taken people to court and successfully sued? I read on a lot of the guidance and newbie threads that a lot of these companies haven't ever sued, or gone legal.....

    Please keep me honest here

Much too late for any appeals, which would not have succeeded anyway

The claimant UKCPS have 6 years to sue victims in England and Wales,  Limitations Act 1980

UKCPS are new to litigation,  probably via Moorside Legal,  so I doubt that any have gone to court yet

Past performance isnt relevant,  Legal companies have signed up many private parking companies in order to sue people for tens of thousands of outstanding invoices

Read the discontinuations thread by Umkomaas to see what tends to happen in many court claims, who blinks first

To emphasise,  no appeal can be submitted,  that ship sailed many months ago

You should prepare for an LoC followed by a court claim pack from the CNBC in Northampton using MCOL

Ps, Not receiving paperwork is no defence , it's usually due to people failing to update the dvla promptly after moving

Why not just search the forum for the word 'Moorside' or maybe  Moorside UKCPS

The forum is a research resource. If you use it as intended, you'll discover so much here that you will learn from.

We've seen lots of Moorside cases and we know exactly what we are doing. They are likely to discontinue claims before hearings. Read some threads exactly like yours to get confident.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We so badly need protected from this greedy nasty industry. Please join the motorists in demanding the re-launch of Govt-backed Parking Code of Practice.
