So after all the faff, the buyers solicitor finally accepted what was proposed 3 weeks ago (i.e. the clause in the transfer document) as opposed to needing a deed of variation.
The developer was adamant one wasn't required and wasn't prepared to entertain it at and if it wasn't for this other sale going through on the estate it might have been a problem.
Contracts all signed and all going ahead so very relieved!0
