Hi all.
I am sure this scenario is in here but i can’t find this specific scenario in the heading and FAQ’s so looking for some help.
My wife parked in a bay which had a LWB vehicle in front of her last weekend and was overhanging slightly without realizing, when they have taken the picture the vehicle in front has changed so it looks like she has parked without due care (it is a legitimate bay), it’s a lease vehicle so Iscrolled down and found the lease vehicle template but within the counter argument it makes no mention of being outside of a prescribed bay, could anyone advise please? Photo attached.

If that is, as it seems, a lease vehicle via Arval, you should ask Arval to formally transfer liability to the named leaseholder, following the 'Transferring Liability' section on the rear of the NtK. Neither you nor your wife can deal with a NtK addressed to another party.Deal with this correctly, and a cancellation is all but nailed on.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi. Sorry for the delay but I’ve been waiting for the paper copy to be readdressed to me. I’m now in possession of the same document sent to my home address with my name on the top, does this change anything? I’m unsure what template to use.

There is a Transfer of Liability section on the back of the form but I am the registered keeper which they quite clearly now know as they have addressed to me at home, Arval are just the intermediary.0

You are definitely not the Registered Keeper, Arval are, They are registered on the dvla database, not you
Presumably you are the hirer or lessee, so hopefully you now have a NtH with your name and address on it ?
Presumably there are no hire or lease documents included in the envelope that the NtH came in ?

Arval UK Limited are the Registered Keeper and it is their name that is on the vehicle's Registration Document(V5c). That is why Arval were the first contact - Premier Park Ltd got Arval's details from the DVLA.
That said, you are the day to day keeper but keep in mind that neither Arval or Premier Park know who was driving on any particular day.
A few paragraphs at the bottom of the first post of the NEWBIES thread offer good guidance on how to appeal this. There are sample appeals there which fit your case exactly.2 -
