Very Return

Hi :) 

I recently purchased a Shark vacuum cleaner on Very.com (for those who aren’t familiar with Very, they’re an online catalog store). 

I paid £379 for it and put it on my account. 

The very next day the same item was reduced to £229. 
As I hadn’t received it yet, I ordered one for £229 and returned the original one when it came later that day. 

I returned it unopened and unused as per their T&Cs. 

I’ve just got a refund today but only for £229 (the sale price) and not the original £379 I paid for it. 

I’ve called them but they are insisting that they can only refund the sale price. 

Is this correct?

    I wish it was true, I would buy an item at the sale price then  return it when it went back up to full price, and claim the current price :)

    Assuming that (1) by returning the original item you were exercising your statutory right to cancel a distance order within 14 days under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and that (2) you had not diminished the value of the cleaner by handling it beyond what could reasonably be done in a shop, then yes, para 34 of the above regulations say that Very must pay a full refund.

    (But if you were returning the original under Very's own returns policy rather than exercising your statutory right to cancel, what you are entitled to depends on the T&Cs of Very's own policy...)

    Go back to Very and tell them that by retruning the item you were exercising your statutory right to cancel, for which you are entitled to a full refund.  Quote the above regulation to them.  Come back here if they won't cough up.
