Rent on Council property when in a Care Home

So am I correct in thinking that when my Dad first moved into his Care Home in June 2023 from that date he should never have been paying weekly rent to the local council for rent on his flat?  He was never given a Social Worker to help us with anything.  The council just kept refusing us to give his flat up.
    Dad lacked capacity and we were still in the process of Deputyship. 
       Nobody here know the council policy but you should start with a formal complaint following what i stated above

    There should have been no problem in giving up flat, and I would have thought they would be desperate to get it back to get someone off the waiting list. I also find it odd that SS were never involved. At the time you really should have got his local councillor involved. I would now raise the issue with his MP.
