New tracking confirmation and possible scams.

Should we be concerned when the new rules on tracking confirmation comes in on Feb 4 that it will encourage scam buyers to make claims for none delivery?
All they have to do is check the tracking showing parcel as not delivered (when in fact it has been delivered) and put in a claim.
The item, still showing as not delivered would enable ebay to refund the buyer from the sellers "holding" account and the seller cannot argue the point as "tracking says not delivered"
This is a concern as in the past I have had a few sales where the tracking has still not updated to this day and no feedback left so to all intense and purpose "not delivered"
