Pothole Claim

My county council are not accepting liability for my pothole claim. They claim they decided on a two hour recovery window due to the severity of the hole and as this two hour repair window had not expired they are not therefore liable. Why on earth did they not do anything to alert drivers to the hole? It was huge and actually due a failed recent repair. Yet because it was dark with no street lights drivers had minimal warning. It warped my alloy. I had to wait for police to help me get to a safe side road where I could receive roadside assistance, by which time I was physically shaking.

Plenty threads on pothole damage if you do a search. You will find out that it is exremely difficult to hold a council liable if they have followed due process.0

You've been unlucky, a 2 hour repair time is pretty quick by the council, they can't repair it if they don't know about it, and to get someone out in 2 hours is good going.0

For there to be a two-hour window, this must have been a VERY major route.
Are you sure it wasn't a trunk route? If so, it's National Highways (or whatever they're called this week) not the council.
Two hours will start from the issue being logged. If whoever logged it didn't have a cone to hand...0
