Terms and Conditions New York Competition

1. GENERAL

1.1 These Terms and Conditions apply to the ‘Win a trip to New York’ competition.
1.2 This competition is organised by New York Media Group B.V., Stadhouderskade 14, 1054 ES Amsterdam.
1.3 The prize is provided by New York Media Group B.V.
1.4 The competition will run from January 1st 2025 and end on the 16th of March 2025 at 23:59.
1.5 Participation in the competition, automatically declares the participants agreement with these Terms and Conditions and the Privacy Policy, Terms and Conditions of New York Media Group B.V.

2. PARTICIPATION

2.1 Participation in this competition is open to persons of 21 years and older, living in and in the possession of a valid passport from the European Union, Norway, Switzerland, Andorra or the United Kingdom.

3. GENERAL RULES OF CONDUCT

3.1 Participants cannot derive any rights from and/or receive compensation for participating in this competition, other than as explicitly described in these Terms and Conditions.

4. METHOD OF PARTICIPATION

4.1 To participate in this competition, the following must be done before March 16 2025 at 23:59: subscribe to the free newsletter via the dedicated competition sign-up form.
4.2 Only emails entered during the dates of the competition, via the dedicated competition sign up form, are eligible to participate in the drawing of the prize.
4.3 Multiple registrations via the same IP address will not be honoured.
4.4 Emails that are already subscribed to the free newsletter before the starting date of the competition, or that subscribed through any other sign up form other than the dedicated competition sign up form, must still be entered via the dedicated competition sign-up form to participate in the drawing of the prize.
4.5 In order to participate in the competition, participants must remain subscribed to the free newsletter until a winner is selected. Participants who unsubscribe from the free newsletter before the winner is selected will no longer be considered for the drawing of the prize.

5. PRIZES AND WINNERS

5.1 The winner will be selected at random by a computer process that generates a verifiably random result from all valid entries received during the aforementioned competition period.
5.2 The winner will be notified by email.
5.3 If the winner cannot prove that he or she is 21 years of age or older or is not in the possession of a valid passport from one of the aforementioned countries (refer to 2.1), therefore failing to meet the conditions, the prize cannot be awarded. A new winner will be selected.
5.4 After confirming with the winner that all qualifications for participation are met (refer to 2.1), New York Media Group B.V. will ask the winner if she/he wants to claim the prize. The winner must respond to New York Media Group B.V. via email within 7 days after notification (exact deadline will be specified in the email). If the winner fails to respond to New York Media Group B.V. within the deadline specified in the email, the winner will be disqualified, and a new winner will be appointed. As a result, all rights to any compensation will cease for the original winner, without any possibility of appeal.
5.5 The prize offered is a 4-day trip, including 3 nights in a hotel, for 2 people to New York with a total value to the equivalent of £2250, for the winning pair. This trip includes: Flights to and from New York, a three-night stay in a hotel room with one double bed and two discount passes for 5 attractions (or an equivalent thereof). Food, drink, travel insurance, ESTA/Visa are not included in the prize. These costs are at the winner’s own expense.
5.6 The prize is non-transferable and cannot be resold, exchanged or paid out in cash.
5.7 The winner will report and pay any potential gaming tax.
5.8 The winner will have to confirm the dates of the trip to New York Media Group B.V. before the 31st of March 2025. The trip will have to take place before the 31st of December 2026.
5.9 New York Media Group B.V. reserves the right to replace the prize, without prior notice with a prize of equal value, if so required or deemed necessary by New York Media Group B.V., due to unforeseen circumstances.

6. PERSONAL DATA

6.1 New York Media Group B.V. will ask the winner for necessary personal details required for executing the bookings included in the prize. This includes a copy of the winning pair’s passports.
6.2 Each participant warrants that any personal information that he or she communicates to New York Media Group B.V. within the framework of this competition is correct, up to date and complete.
6.3 The winner gives New York Media Group B.V. consent to use his or her personal details (first name and first letter of his or her last name). In addition to a photo, taken on the winner’s New York trip, selected by the winner for marketing/public relations purposes only. This can be referenced on any medium, with no rights to compensation, right or benefit, other than the awarded prize.
6.4 By entering this information, the participant agrees that New York Media Group B.V. records this information in line with GDPR and uses it to award the prize.

7. LIABILITY

7.1 New York Media Group B.V. and any of their employees or affiliated third parties are not liable for any damages or expenses incurred with relation to participation in the competition and/or lack thereof. Be this relating to the awarding, acceptance or use of the prize.
7.2 Participants agree that they participate in the competition at their own risk and the participant is responsible for the conclusion of travel insurance.
7.3 New York Media Group B.V. is not liable for (the consequences of) any defects in the prize.
7.4 By accepting the prize of the competition, the winner declares his/her agreement with all articles from these conditions.
7.5 Printing or other similar errors cannot be invoked as grounds for additional obligations for New York Media Group B.V.

8. REMAINING

8.1 New York Media Group B.V. reserves the right to adapt or amend these Terms and Conditions during the course of the competition or to terminate the competition early if deemed necessary. Participants cannot derive any rights from this towards New York Media Group B.V.
8.2 This action is conducted on the basis of the code of conduct for promotional games of chance.
