Hello everyone
The driver parked in a 20 minute area and went in to Greggs Bakery with an autistic gentleman with dementia. After buying some food, the driver, a support worker and the autistic man he was supporting went to post a letter. At this time the autistic gentleman, had a challenging episode. he sat down on the pavement and wouldn't move. The driver was about 5 minutes away from the car, but couldn't leave the gentleman on the floor. Eventually the driver managed to get the gentleman off the floor and in to the car. The driver was very stressed!
Is the response below ok to send first of all?

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

In addition The driver is a support worker and at the time was with an autistic gentleman with dementia. The autistic gentleman with dementia had a challenging episode, where he sat on the pavement and wouldn't get up. it wasn't until after some time that the driver managed to get him up and in to the car. The keeper is asking for an adjustment and cancellation due to the fact the autistic passenger with dementia has protected characteristics under the Equality Act 2010 and you and your client has a statutory duty to allow additional time for such visitors/unplanned events.

UNLESS the NTK is non-POFA? If that's the case you obviously take that tack.

I have searched the newbies thread and found this about The Protection of Fredom Act POFA

Using the information above I can see that unfortunately the Protection of Freedom Act is mentioned on the PCN.
I will submit the appeal today, explaining what happened.1 -

I am appealing this Parking Charge Notice on the following grounds.
The driver of the vehicle is a support worker and was with an autistic gentleman with dementia at the time. The driver went in to Greggs Bakery as the autistic gentleman with dementia wanted to buy some food. Afterwards the driver and autistic gentleman with dementia went round the corner to post a letter. During this time the autistic gentleman with dementia had a challenging episode, where he proceeded to sit on the pavement and not move. The driver tried to get him up, but the gentleman refused. The driver was 5 minutes away from the car, but couldn't leave the gentleman on the floor. After talking to the gentleman for some time, the driver managed to get him off the pavement and in to the car.
The driver is asking for an adjustment and cancellation due to the fact the autistic passenger with dementia has protected characteristics under the Equality Act 2010 and Britannia Parking and your client has a statutory duty to allow additional time for such visitors and unplanned events such as this.

I have appealed today and I have received an automatic email response saying that they have recieved it.On a side note the link on their home page says to go to is not the correct. The web address on the back in small print of the PCN is the correct one. Very naughty in my book.2

Just to update. I haven't received any information as of yet. I did go to Greg's but no such luck. They are just youngsters working there. No information on signs about landowner.0
