    So never help a family member with their car or van insurance to get them stared as you will end up paying if their in default what a rip off should not be happening, keeping people's data when told not to as I did say over the phone that no other payments was to be taken out of my account and to be cancelled.
    It's likely that there is no way to purchase without consenting, certainly online there is no option.

    The only choice is for them to replace your card with theirs straight away but an insurer may not be able to do so if not in a situation where a payment is needed.

    Your brother in law would be advised of the cancellation fee in his policy document. 

    He must know he has not  paid it. 

    If your brother in law  cancelled his payment details, then HD  used the other payment details on the policy. 

    Your  brother in law’s default is between you and him.

    You need to ask him to pay you the cancellation fee.
  • My point is that yes I paid the first payment for him to start his policy but I specifically told the sales representative that no other payments was to be taken from my account as my x brother in-law had set up his payment agreement before his first monthly payment so I believe that my details should have been deleted from their system as he had taken full responsibility for his policy,I did not know that his van would break and he would cancel his policy as it states within the policy agreement that he had signed,when I phoned the representative said that I was a third party but as they did not contact me for my consent the within their agreement it states that they should have ,then surely they had breached their own contract.

    The contract talks about DDs from a third party bank account, you didnt set up a DD from your account

    It would be helpful if you gave the clause number in the text you photographed where you believe it states they are obliged to inform you? If you are talking about point 14 then the "you" as defined earlier in the policybook is the policyholder. They will have told the PH at the time he contacted them to ask them to cancel the policy and so fulfilled that requirement.

    What you actually need to look at is the Continuous Payment Authority section which you can just see the header of but not the context of just below where you took the photo. 


    Ultimately have your BiL register a complaint with them but all they will do is require that he pay them by another method and then they'll refund you. On the basis you are presumably struggling to get the money from your BiL I'm guessing he won't be assisting you in registering the complaint. 


    Alternatively you could attempt a chargeback via your bank on the basis you explicitly stated you didnt consent to the CPA however they may require evidence of that from you which without the complaint it will be next to impossible to prove. I mean you could attempt a DSAR for a transcript of the telephone call given presumably your PII was mentioned but thats going to be messy
