Executors duties when selling property

  • I think the main problem your executors will have to deal with will be the ongoing management fees, so as long as your estate has sufficient assets to cover those for a couple of years then their life should not be made too difficult.

    yes agree, it is the paying of the management fees after death that can prove costly

    This made me chuckle, as I too am getting to an age when I want to simplify my life, not complicate it.

    I don't think you should be too prescriptive in what you tell your executors in any memorandum. You have to trust them to act sensibly, and you don't want to fetter their flexibility.

    Essentially, what you want to tell them is that they may be better off selling cheaply and quickly, rather than hanging on for top dollar. But, maybe it would be better to say that to the beneficiaries, so they don't expect too much? 

    I haven't heard anything good about the 'buy it now' companies, and I can't see them paying much at all for a retirement flat with large outgoings.

  • You may have done this already, but I'm wondering if these instructions may be even more relevant to share with whoever would be your POA if you were to lose capacity and need to go into a care home. It would give them some evidence of how you would prefer things to be managed.
