Civil Enforcement POPLA stage

Firstly, thanks for all the useful content on this forum, it's been most useful already.
Very briefly, I have a NTK for not entering my reg correctly. I've appealed using the template, which of course was rejected.
I'm trying hard to go Plan A but the response I've gotten has prompted this thread. I parked at Every Active leisure center and contacted them direct through Facebook (of all places). They've responded stating:
"In the initial months after the installation and system going live we had the capacity to remove charges. We only now have the capability to reduce as stated in previous correspondence"
This is a reduction to £25.
My question is can these parking companies dictate in this manner?
Also, from reading other posts by Coupon-mad, I believe the current advise is not to bother with the POPLA appeal?

Surely the rejection letter offers to settle at £20 because it's a keying error? Did you point that out by adding that to the template appeal?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry for delay, I didn't get a notification.
No, I sent the template appeal out before additional contact through FB (originally I tried in person but got nowhere).
The rejection letter does not offer anything other than the standard £60 reduction from £100 if paid early. They state there are no records of my reg or anything resembling my reg in the records.0 -
How do you know the PCN is for not entering your reg correctly. How much of the VRM is wrong?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Technically it's for not entering it at all. The leisure centre has one of those touch screen terminals at reception.
The PCN wording, and their appeal rejection, is based on them having no record of my reg or anything resembling it) during my stay. I use it most weeks, I may well have missed it, but I thought I had.

Try POPLA because even if you lose you won't be paying.
And the POPLA process will get you two important pieces of evidence (useful for court defence later - if you download and carefully save the evidence pack - and you won't get either of them any other way):
1. Landowner contract
2 The VRM logs showing whether of not there was a close match or major VRM typo.
DO NOT PAY.
How to do POPLA is in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Coupon, I appealed through POPLA and I have the evidence pack. I now have 7 days to reply so I thought I'd check here before I either say something I shouldn't or if I'm simply wasting my time.
My main gripe is the lack of any form of receipt or paperwork after entering the Reg. The Civil Enforcement signage uses language referring to 'obtaining a parking permit by registering on the touch screen'.....we do not obtain anything, so there is no way for the user to understand if said permit is valid or not. This annoys me greatly; ticket machines directly provide a permit, digital parking apps provide a digital permit, why should this be any different!
Is it worth me adding a comment as such or am I just wasting time? Also, the evidence pack does not contain any photos of the touch screen. I have some as I'm now having to take photos every time I enter my registration as it's the only evidence I can 'obtain'.
Thanks in advance.1 -
But aren't those 'seven days' for you to comment on their response?
It is not an opportunity for you to introduce, or even repeat, appeal points.2 -
Comments stage is already explained in the NEWBIES thread.. POPLA is unimportant, win or lose.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Unsurprisingly, the POLPLA result is unsuccessful. I'll post over in the POPLA decisions thread.
A rather annoying response; they have completely disregarded one of my points, and used the date of the email I provided as evidence of the booking to use the facility as evidence I was not a legitimate user of the site on the day the parking event occurred. It was booked the day before hand!
So I now just ignore any threatening letters?
