Ebay Purchase Query

Hello,

I purchased an ex display iPad from Ebay in March 2024 for a relative. Paid using Paypal Credit. The iPad is no longer charging as of yesterday. Purchased a new cable to rule that out. Old cable and plug happily charge my iPhone. The iPad was listed with a 12 month warranty. Contacted seller to inform them of the issue and for advice about the warranty process but they do not appear to want to help. They are business seller so contacted eBay who said they cannot help.

I know I may be entitled to a repair or replacement I believe under CRA. What are my options here?

    As it's over six months old, the onus will be on you to show the fault is due to a manufacturing fault that has just come to light and not down to user damage. You can get said report from a mobile phone shop.
    If this is in your favour, you can ask for a repair, replacement or refund, but the seller can choose the most cost effective option. Any refund will have a deduction for the use you have had. You would also get the cost of the report back.

    Consumer rights and warranty are two different things. Depends what the T&C's of the warranty state.

    I don't want to be overly pedantic but I think the OP needs to be clear about what their legal rights are here?

    Assuming the OP can establish it had some "latent fault" when purchased, then after 6 months they are legally entitled to ask for either a repair or a replacement, but whichever of those two they ask for, the seller can provide the other if the remedy the OP asks for is disproportionate (eg too costly, too difficult, impossible).  At this stage the OP has no legal entitlement to ask for a refund.  (Of course the OP can ask for a refund, but all the seller is legally required to do would be either to replace or to repair).

    The OP isn't legally entitled to a refund until the attempted repair or replacement fails, but you are right that after 6 months from purchase the seller can reduce any refund to reflect the OP's use of the iPad.

    @mrjermaineh -  whether or not this fault is covered by the warranty depends entirely on the T&Cs of that warranty.  We can't tell you what is and what is not covered.  Not all warranties are equal.

    Do you know if the warranty is one provided by the seller or is it an apple warranty?  If the latter, has it bben transferred from the original purchaser?  Do you know?

    Just for info, the 6th Gen iPad was discontinued by Apple in 2019 so unlikely to have an Apple warranty which would have been transferable any way.
    Try blowing some air into the charging port as these can get dust and dirt in them which would inhibit charging, a common fault on iPhones etc. Also you could try taking it into an Apple Store for one of their Genius engineers to check, this is normally a free check but you will have to book in advance, hope this helps :smile:
  • Warranty provided by seller. I was directed towards some very hidden small print at the bottom of the listing which said they do not cover battery defects after 1 month which I thought was sneaky. My fault I suppose as I should have gone thought the listing with a more careful eye.
