Stuck don't know if legal or moral issue

I am really at the end of my wits now, I had an issue with my car I bought Feb 24 used 4 year old at point of sale I paid cash and was talked into extended warranty I paid an extra £900 for this fast forward to xmas eve I noticed a smell of coolant from my car looked under Bonnet and noticed i had a cracked coolant tank i left it until after Xmas as nothing was going to happen before it phoned branch where I bought car told them I had a cracked tank and could I book in they asked about extended warranty I said yes I bought that in Feb they said so you did, took car into garage got phone call to collect and on arrival got told I have a cracked tank that's covered by manufacturer warranty that will be £95 now you have to phone manufacturer to get repaired as my extended warranty doesn't start for an other 2.5 years. I have been mis sold a warranty with breakdown cover that starts July 2027 and they charged me £95 to tell me what I told them both on phone and when dropping car off when they knew my warranty had not started. So I phoned manufacturer they informed me my car has not been serviced before i bought it so manufacturer warranty is void as garage i bought from did not register service can someone please help if anything can be

    You paid the £95 just for them to tell you it had a crack in the coolent tank which is what you told them when you brought it in?!?! Why?!

    For starters insist on this being refunded as they can't charge you for telling you something you told them.

    You have paid for and got an extended warranty. That's not an issue.

    The thing you need to address is the regular manufacturer  warranty. If the car was sold with this and it would have covered a cracked coolant talk then the dealership should cover this cost.

    Sounds right. If car is not serviced as per schedule, then warranty is void.

    So the extended warranty should be in place. So OP needs to contact warranty co. But even then item may not be covered.

    So cheapest option would be to source a new one & replace. Once they have got the £95 back from dealer.

    Which dealer are you talking about?

    There are a number of traders such as ALA and Warrantywise who sell third party warranties for Kia. Apparently you buy them at any time but they don't become active until the 7 year Kia warranty times out, which explains why the OP says it doesn't start for 2½ years.

    @irvy1237, you should check that the extended warranty is not conditional on the vehicle having been properly serviced. If it is the contract of sale might be frustrated (meaning you could never claim on it) so you might be able to claim your money back.

    The £95 might be a diagnosis fee.
    When I took my Kia in for a minor repair last year, they warned me that I might be charged for a diagnosis fee to determine that the fault would be covered by warranty (I wasn't charged). I presume that if the fault had not been covered by warranty the fee was to pay for the mechanic's time and skill. My dealership is Arnold Clark in Scotland

    Yep, Kia franchise dealers (only one actual Kia dealer. Bolton) are well known for diagnostic fee's before looking at warranty claims. Which is fair enough. So dealer needs to recoup the cost of their time. As they are not paid by manufacture for non warranty work.

    Will just have to wait & see if OP comes back with answers.

    Clearly they bought from a 3rd party dealer. So even if it is a warranty claim, no good going to selling dealer, or after 6 months expecting them to replace washer bottle.

    Thanks for reply. It was a diagnosis fee but I had already told them the tank was cracked. Dealer was parks but they have just bought over peter vardy, the dealership I bought my MG from sold me an extended warranty with breakdown cover and neglected to tell me it won't start until 21.7.27 so i cant break down for 2 years a little bit annoyed. As peter vardy serviced before I bought car and they are no more, I can't prove to MG it was serviced and I have not contacted my extended warranty yet as manager from parks was trying to source invoice for service carried out before sale, but heard nothing from them in past week so looks like contact warranty company ask them if car service record not up to date is warranty still standing if not will I be able to claim my £900 back for warranty?
