No Fault out of Pocket Expenses that Insurance company say they cannot claim for from Third Party.

My car was rear ended by a Third Party, and its a No Fault claim.

I have had to pay £80 to retain my Licence Plate, as the car is written off.

My Insurance company say they cannot claim for the out of pocket expense I have incurred from the Third Party's Insurer.

Is there any way I can claim any out of pocket expenses I've incurred that is not payable by the Third Party's Insurers, either direct from the person at fault personally or via a court claim.

Any advise will be helpful.

    You could try a court claim against the driver at fault but personally I don't think it's worth the time and effort.

    You insurance company will cover insured losses which typically is limited to damage to your vehicle and a token amount of contents that was damage inside the vehicle. Anything else is an uninsured loss such as injury, your excess, if you have to take time off work and so have loss of earnings etc. 

    If you have Legal Expenses cover on your policy, normally an optional extra, then your insurers will appoint an appropriate firm to assist you in getting your uninsured losses back from the Third Party Insurer (TPI). If you dont have LE cover then you can claim them back yourself from the TPI. Your insurers should be able to advise you of the appropriate contact details and claims reference to use with the TPI. 

    By law motor insurance must cover the liability of the driver to third parties so there is nothing that you can claim from the third party themselves that you cannot claim from their insurers (technically most insurers have a £20m cap on property damage but I'm assuming we arent pushing against that, its unlimited for injury). 

    Its not clear from your post if your insurers simply meant they won't help with uninsured loss recovery because you dont have LE cover or if they are advising you that they dont think licence plate fee will be accepted. Ultimately their opinion doesn't matter too much as it's the TPI that will decide if they will reimburse it or if they are willing to go to court over it.

    That's your choice. The vehicle and the number plate belong to the insurer when the car is written off.
