HELP NEEDED with PCN on private land

Any help would be appreciated. The driver parked outside Nando’s in Headingley Leeds as they assumed it was their customer car park. Upon looking on website linked, they only have one time stamp which is when the driver came into the car park not of them exiting. However, they have taken photos of the driver getting out of the car and also going into nando’s. Could they have more evidence or would it have to be on the website? Thankyou in advance.

    Welcome and Happy New Year!

You can look on their website but apart from that, do nothing unless you move house or receive a LBC or Claim Form.

Just ignore them. There's no appeals service with trying. Only steps to take:

    - Tell them if you move house within 6 years.

    - Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.

    - Come back if you get a LBC as per the 2nd post of the NEWBIES thread. There is no risk in defending a claim.

Everything is explained in that Announcement thread at the top of the forum. No link needed. See my signature for how to navigate around.

Email the LoC template response to Moorside Legal  ( its in the 2nd post in the newbies sticky thread in announcements near the top of the forum by coupon mad   )
  • Thank you, it's very much appreciated.  Can I ask if they have a photo of the driver exiting the driver's side,  can I still challenge that the keeper is indeed the driver as per VCS v Edward, 2023

Just taken these points after reading the newbies thread

  • Apologies, I might have worded it incorrectly and I thought I had posted this but didn’t click send! What I mean is that can the driver challenge who they are stating is the driver? Although there's a photo of the driver coming out of the driver's side.
  • I have also received this correspondence
The driver has also received this response to their snotty email. Any advice on what to do moving forward?

    Do nothing.

Await the claim firm then defend with our template defence (read it now if you want - see the thread of that name). It's all very very easy.

HOWEVER - THIS IS NEEDED NOW:

Please read this message and do the vital,  current Public Consultation:

    https://forums.moneysavingexpert.com/discussion/comment/81552148/#Comment_81552148

It's important that the Government hears from people like you with unfair charges who are facing 'scary' court claims.

The link shows the two vital points to concentrate on, IMHO:

    - banning 'fee' add-ons completely.

    - making sure a new SINGLE appeals service replaces POPLA and the IAS which are seen as not fully independent and involved in a 'race to the bottom'.

Click through to the main thread about the Consultation, Do not be deterred by the fact that some questions are for the parking industry only.

We are currently discussing how to respond. Please join us in doing this Consultation before it closes in three weeks. This is your one chance to make a difference re the proper regulation of private parking.
