Multiple collection notices from ZZPS

Hello all.

I am posting on behalf of a friend of mine and I have read the newbie posts etc but I am still unclear of next steps and would really welcome some advice if possible.

So a week or so ago my friend received multiple letters from ZZPS in the form of 'Debt Collection Notices'.

The alleged infractions were due to allegedly parking in a railway train station carpark operated by everyone's favourite company APCOA Parking Ltd. On the letter from ZZPS it says they are for 'Penalty Notice Number' with the offence being 'Use of a private car park without making valid payment'. As an FYI the carpark uses ANPR cameras 

Now my friend never received any letters from APCOA about this. The V5C of the vehicle was apparently allegadly not up-to-date but I am told this has now been allegedly rectified so this might be the cause of lack of letters. I have included the months of the alleged infractions below.

May 24
June 24
October 24
July 24
December 23 (yes that's 23)
March 24
April 24 times 2
March 24

As you can expect the good folk at ZZPS have also added on their signature 'Administration fee' of £70 on top of the 'Penalty Notice Amount' of £85.

As you can imagine this has caused my friend a good deal of stress given the amount and how much it all equates to.

I should also mention that ZZPS also somehow managed to email my friend a couple of days ago saying to get in touch with them - zero clue how they got this address.

As it stands my friend has not contacted ZZPS in any way (and doesn't intend to) nor APCOA.

I of course cannot comment on if my friend was driving the vehicle or not, nor who the registered keeper is.

And of course ZZPS have put the usual guff of 'a breach of railway byelaws is criminal offence'

Could anyone on here please advise on what to do? As I said I have read the newbie guide but am still stuck on this.

    Debt collectors are powerless and can safely be ignored as advised in the fourth post of the NEWBIES.

    APCOA are benign and to date have never taken anyone to court, and make enough money they are unlikely to bother in the future.
    In any case, an unregulated private parking company cannot bring a criminal prosecution in the Magistrate's court for an alleged breach of bylaws. Any such case could only be brought by the landowner (Network Rail or whatever they are called now) or the train operating company. Even then, any payment would go into the government's coffers, not to the rail companies.
    In addition, an alleged breach of parking terms is not a bylaws breach.

    On top of all that, any claim for a bylaws breach times out after six months.

    Your friend is safe to continue to ignore, but should perhaps try to work out why they keep getting so many tickets, and take remedial action accordingly.

    I'd email ZZPS back (email comms are good as you have proof of sending) and tell them to wind their necks in because everyone knows that a Penalty Notice is statute barred after 6 months . Refer them to the famous response given in Arkell v Pressdram.

    I'm not joking. Google it. Tell your friend to respond like that.
