Smart Parking Fine - McDonalds - 2nd Appeal

We stayed at Mcdonalds 2 hours 2 minutes (90 minute allowed) - there were 3 families with babies & toddlers.
Food took literally an hour to come then ice creams took 30 minutes, and staff were apologising to everyone.

My wife is registered keeper but I was driving.

Initially when we got the fine I hadnt read these forums snd replied saying that it was ridiculously busy and waited 90 mins for food overall.

This counted as an appeal & they replied rejecting it.

I then read forums and sent an appeal on behalf of my wife basically saying "You have sent this to me as the registered keeper, however I was not driving and I will not assist you with your enquiry to find the driver"

They hsve rejected again and said no more appeals allowed.

What are the best steps to take?

Popla,  with the typical Popla appeal,  something like

The claimant has no landowner authority at this site,  plus thy also failed to comply with pofa 2012 so the keeper has no liability

The RK does he appeal , no blabbing about who was driving or about the incident itself

But, the RK should be complaining about the PCN to the business or retail park management company or landowner first,  should have been done when the pcn arrived in the post,  known as plan A

Who has been given the POPLA Code?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Please support/sign this petition demanding the re-launch of a Government-backed Parking Code of Practice. 🙏

    Hi,

I can't see a poplar code on the letter anywhere!

On a rejection letter, there's a POPLA Code at the top. If there isn't, then it's either not a final appeal rejection or the appeal was very late.

Hi, yes there is a POPLA code on there.
We have now had this through.

What is the best next step?

Presumably you failed to use the popla code,  so possibly missed the 33 days deadline to submit it

Ignore the debt collectors letters,  see post 4 in the newbies sticky thread in announcements near the top of the forum

So you missed the POPLA stage?  This is a mess and would have been a pushover for your wide to win last year.

    Who got the POPLA Code?

    Who got this joke threatogram?

Luckily it's only Smart Parking, who never sue anyone. Only letters and texts, etc.

Sit tight. Do nothing except the below.

By going confidently into the 'ignore' stance, the only steps to take are:

    - Tell them if you move house within 6 years.

    - Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread. Did you miss the pictures of the laughable DR Plus and other £170 letters already shown, that we never want to see again?!

    - Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.  You won't!

But if Smart break the habit of a lifetime, there is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.

Please answer my two questions above.
