Hi i just want know where i stand. So i was employed as a carer through a gentlemans solicitor the gentleman passed recently after 9 years of working with him 1-1. Obviously its sad and its never just about money i just want to make that clear i had a great fondness and cared greatly for this gentleman. I however was contracted to work and i have checked my contract and there is nothing in my contract about if i will recieve any pay. It only stipulates if they need to end my contract or if i need to leave that i give a months notice. I have asked if i might recieve say a few weeks pay in the interum period but as yet its all like well im going to ask the executers but im not sure.

If you were formally employed then I imagine you would be entitled to redundancy pay as your position is no longer required and so you are redundant

If you were employed (not self-employed under contract) then you are now redundant ( definition of redundant - no longer has a useful purpose) however yes, they should give you your redundancy notice and pay. Obviously cut the grieving family some slack but until you receive notice I would think you are still employed
Imagine you were working for a company that made widgets. Suddenly another company make the same widgets at half the price and your company can no longer sell theirs and is no longer making the widgets you are qualified to make and is concentrating on something different which you can't do. Can they just stop paying you because they have no work for you? No, they have to go through redundancy process even though you have nothing to do while it proceeds0 -
Assuming a contract of employment was in place with the deceased then S136(5)(b) of the Employment Rights Act 1996 recognises the contract has ended at the date of death and that the employee is made redundant.0
