ParkMaven Alleged Overstay
Previous_Not_Anon_Enough
Hi,
I have received an invoice from
ParkMaven about an alleged overstay. I believe I paid for 24 hour's
parking, and this was done via a third party website (YourParkingSpace).
I did not receive a receipt for this, but I had a successful
transaction, and YourParkingSpace states on their website that this is
adequate proof of payment, so I didn't think much more of it.
The
NTK states I overstayed authorised parking, but does not give details
of times. I assumed this was a simple case as I have actually had a
recent issue with a parking invoice with ParkingEye for a similar issue
which was successfully appealed, but of course they've denied the
appeal.
I entered the car park in the morning,
and left the morning of the following day for a period of about 21 hours
in the car park. ParkMaven are claiming I paid until midnight only, not
midday. I have a few questions from this:
- I
want to refute that I only paid for marking until midnight. Whilst it
could be a mistake on my part, it seems a silly one, and one I don't
think I would have made. But as I didn't get a receipt at the time, I
wouldn't have known.
I now have a VAT receipt, but it doesn't have my name, email, or telephone number. They are replaced with YPS's details. So I don't know if I messed up the order, or they have had glitch and fabricated the receipt
I'm struggling to recreate it as I think the signs at the car park use a different link than the website. The website only allows me to pay in 30-minute increments, but the VAT receipt is from the time I paid (though the website it 24-hour format I I do not believe I would have chosen 00:00)
So I think something funky has happened with the payment process, but I'm not sure how to take this - Secondly, the cost for parking until midnight or midday is exactly the same. There is no loss of income!
I feel there is something to this point, but I am not sure how to proceed again. Essentially, the carpark is £15 for 24 hour's parking, which I have paid. But if I did make a mistake, I have still technically overstayed...
I am currently complaining with the
landowner so hopefully this will proceed in my direction, but if not
could anyone please advise some specifics for how to proceed with the
POPLA appeal?
Apologies also if this is exists, I did try and search the forum...
Thank you

You won't be paying this (ever) but:
What does the sign say?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The hotel cancelled the ticket!
But thank you nonetheless. Though for what it's worth, I can't get details of the sign. I didn't take a picture at the time and I can't see the detail in Google Maps or anywhere else.
I was curious how this would go though. I didn't think it would hold up if they went to court, but I expected POPLA and the hotel to keep saying 'well, technically...'

They may well have done, but the chances are that the claimant parking company and their lawyers would have dscontinued before the hearing, so you will never know
Plan A is that name for a good reason, and it worked because you complained to the hotel and they did the right thing by cancelling the pcn. Plan A has been the best course of action for over 12 years3 -
Nicely done. Plan A strikes again!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Another "fine" off the back of this plainly faulty app.Getting to suspiciously become a habit.2

We got the same. Paid by QR code, got receipt, then the notice followed. Plus my partner has a blue badge. Totally ignored it, and the reminder, and heard nothing since. Hoping it may go to court to make them look like fools.1

Yep. Sit tight. Do nothing except the below.gauldy said:We got the same. Paid by QR code, got receipt, then the notice followed. Plus my partner has a blue badge. Totally ignored it, and the reminder, and heard nothing since. Hoping it may go to court to make them look like fools.
By going confidently into the 'ignore' stance, you MUST make sure you see all letters, so the only steps to take are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread.
- Come back if you get a solicitor's LBC as per the 2nd post of the NEWBIES thread.
Nobody pays a penny and no hearing is even needed in most cases. Search the forum and read a few cases as they are easy to beat by waiting for a claim form - it is easier than appealing!
There is no risk AT ALL in defending a court claim. No CCJ. No bailiffs.
Parking firms know that scam QR codes are overlaid on theirs (if that is what happened) and this is a known matter and a problem for the industry to shoulder the burden to resolve, not yo penalise duped consumers.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
