Euro Car Parks Sheffield - DCBL letters

Hi,

I have received letters from DCBL ltd requesting payment for a parking charge from Feb 2024 due to - no valid pay and display/permit was purchased.

My V5c was registered to an old address (now updated), so the DCBL letter I received was the first notice I had of this.

Being unaware of this forum at the time, I made the mistake of contacting DCBL via WhatsApp about the issue.

In my message to them to query/contest the fine, I said that I had paid for parking,  had a record of this on my partners bank statement and had no communication from the parking company about the charge or chance to appeal (thinking that updating driving licence not v5c address was needed when moving house).

Having read the Newbies threads since then, it is clear that there should be no admission as to who was driving.

Any advice on whether or not I have accidentally implicated myself as the driver through those words and what to do next would be appreciated.

Whilst working out what to do and reading the info on the forums, I am at the stage where I have received a third letter from DCBL titled - final notice of debt recovery.

Any advice/support would be appreciated.

    IGNORE the debt collectors letters,  but not an LoC or court claim

    It is not a fine.

    Plan A is always a complaint from the keeper to the landowner and the keeper's MP.

    For the latter, ask their MP when the mandatory parking code of practice is going to be introduced, and ask the MP to forward this issue to the MPs who are currently trying to get the government to implement the mandatory parking code of practice, as can be found in this post.

    These actions are the only way the unregulated private parking companies will ever be brought under control.

    If Plan A fails, then wait for a Letter of/before Claim or a court claim to arrive, then follow the guide to court written by bargepole from the sticky Announcement for NEWBIES, and the Template Defence sticky Announcement that includes a twelve step guide to the process.

    Without knowing precisely what was put in the Whatsapp contact with DCB Legal Ltd, it is impossible to tell if the driver's identity was revealed. However, if the NTK was PoFA compliant, then it doesn't matter.

    Have read the info, have changed my contact address with both DCBL and ECP and am now going through plan A - complaining to ECP. 

    Any thoughts on specifics of what to complain about in this case?

    Harassment by DCBL?
    The driver having paid for a parking ticket - unproportionate charge?
    No evidence of contact breach to current address?

    I will complain to MP and sign petition and mention this in my complaint to ECP.

    Plan A is to complain to car park Landower not ECP they will not be the owner.

  • Thanks, I can’t find the owner of the land anywhere. Worth complaining to ECP, paying land register to try and find the landowner or just wait for the next stage?

    No point complaining to ECP, they are a 3rd party contractor doing their "job",   deaf ears 

    Complaining about the PCN to the landowner is certainly your best option,  whoever it is

    Wait for the Letter of Claim followed by the court claim,  once a claim has been issued then the end game is in sight,  a discontinuance by ECP & DCB Legal,  like the hundreds in the newbies sticky thread in announcements 

    Ignore any debt collectors letters 

    Sign the petition to invoke the new mandatory code of practice 

    Complain about it to your local MP too
