Sainsburys / EURO Carparks PCN

Thank you all for contributing to this site! The wealth of information here is truly incredible, though I find it a bit overwhelming at times.

I appealed a PCN on behalf of my elderly mother and got the following response:

Having carefully considered the evidence provided by you we have decided to reject your appeal for 
the following reasons:
• The car park is operated by Automatic Number Plate Recognition (ANPR) – cameras capture 
an image of vehicles entering and leaving the car park and calculate their length of stay. 
• The car park in question is on private land and upon entering such land vehicles are subject 
to the terms and conditions of parking as shown on the signage. This signage quite clearly 
states that if your vehicle is in breach of the terms and conditions of the car park then a 
Parking Charge Notice will be issued.
• Parking at the above site is limited to 120 minutes during store trading hours. There is a 
maximum stay of 10 minutes outside of store trading hours.
• On entry to private land it is the responsibility of the driver to check for signage and ensure 
that your vehicle has been correctly parked. 
• Your vehicle was parked longer than 120 minutes, therefore the notice was issued correctly
and remains payable.
• Euro Car Parks do not need to provide evidence of who was driving the vehicle, it is the 
registered keeper’s responsibility to provide a serviceable address of the driver, within 28 
days of the Notice to Keeper NTK (this serves as your Parking Charge Notice PCN). 
• If the full amount remains unpaid, under Schedule 4 of the Protection of Freedoms Act 2012 
(‘the Act’), Euro Car Parks have the right subject of the Act to recover from the keeper of the 
vehicle at the time it was parked so much of that amount which remains unpaid.
• Any form of parking ticket or ‘notice’ is issued under the law ‘of trespass and Contract Law’. A 
driver who is invited (or chooses) to park on private land and use the car parking facilities and 
pays a fee/s does so under a contract (signage) with the car park operator. The parking 
contract sets out the terms that apply to the parking service, including the price. 
• The contract (signage) clearly states the extra charges are that the driver will incur and have 
to pay if they decide to break the contract terms − for example, by parking longer than the 
time paid for or exceeding the maximum time limit applicable.

 3. Post: Make your cheque payable to Euro Car Parks Limited (include a £2.50 handling
 charge for cheque processing) and post to Euro Car Parks Ltd, 30 Dorset Square, London,
 NW1 6QJ, quoting the PCN number on the reverse of the cheque.
The parking charge notice will be held for 14 days from the date of this letter to allow time to make 
payment.
You have now reached the end of our internal appeals procedure.
You can make an appeal to the Independent Appeals Service, POPLA (Parking on Private Land 
Appeals) using the unique POPLA Reference code provided above. Please note, should you decide to appeal to POPLA, or if you appeal to POPLA and your appeal is subsequently rejected, the option to pay the discounted amount will no longer be available and the Full Amount of the PCN will be due.
Please note - if the parking charge notice was issued in Scotland and or Northern Ireland, only “The Driver” can appeal to POPLA.
If you decide to appeal to POPLA, you will need to visit the website, www.popla.co.uk where further details of how to appeal (either online or by downloading the relevant forms) can be found. If the driver is unable to access the website, please use the contact us page at ----. Please ensure that the POPLA Reference Number as noted above is quoted on all correspondence to POPLA. You have 28 days from the date of this letter to submit an appeal to POPLA. If you appeal to POPLA, the parking charge notice will be placed on hold.
Appeals may not be accepted if payment is made against the Parking Charge Notice, including any  appeals logged via POPLA.
If you choose to ignore this letter, we will seek to recover the outstanding amount owed to us through the debt recovery process and procedure, this may lead to court action against you.
By law, we are also required to inform you that the Ombudsman Services (www.ombudsmanservices.org) provides an alternative dispute resolution service that would be able to assist with your appeal. Please note, we have not chosen to participate in their dispute resolution service and as such, 
should you wish to appeal then you must do so to POPLA, as detailed above.

    Not being the driver is no defence to the core breach of overstaying,  especially if ECP complied with the law named pofa 2012

    Plan A is the best option here,  complaining about the PCN to the business  ( Sainsbury's   ) , or retail park management company or landowner,  as is appropriate,  getting them to cancel the pcn ASAP,  same as you would for Morrisons,  especially if she was a paying customer 

    Surely the store manager can assist   ?

    No it wouldn't help at all because it won't win. Forget POPLA.

    Just get Sainsburys to cancel it.  Get angry!

    Is Mum very elderly, such that she is slower to get around & shop? Does she have a Blue Badge?

    If not, does she have mobility issues anyway? Does she need more time? She should be on a white list to exempt her.

    Do you realise that it is illegal to hold disabled or slower/elderly people to fixed ('free or you get fined') shopping parking time limits?

    I had a PCN at my local Sainsburys on 6/11/24 but the letter did not drop through my door until 16/1/25, over two months later. I agree that I had outstayed, but had used the store. Unfortunately I was in my business van ( I am a sole trader ). Having received the very late letter I tried contacting Euro car parks and was informed that my fine had been transferred to a debt recovery agency who I contacted immediately and was told my fine had risen to £155. I had to pay this as I was also told that the day that I called was the date it was being transferred to the next level up. I was also told that I should have received a second letter from euro car parks which should have been the reminder when the fine rose from £50 to £85. I have never received this second letter. I also asked for an invoice from the debt recovery agency who asked for an email, but never received this either. I went into my local store to complain and was told it was out of there hands and gave me a number to call euro car parks. This is an automated answering service which says they will only accept challenges in writing.
    Being a business van I would have paid the fine straight away, as it was a fair cop as it was there with camera images  but never got the chance. Now my business credit rating has gone through the floor. Will revisit Sainsburys but not holding out much hope.

    None of this makes any sense to me.

    Surely you DIDN'T believe the scammers and paid them £155? No...please say you didn't?!  You don't phone nor pay parking debt collectors!

    And it can't affect your credit rating. If that has happened, it will be a different case.

    We think your van's logbook has your old address on it, which is why you are not receiving the first PCNs and may have missed a court claim form for the other case (the one that caused your credit rating to be affected).
