Update on my appeal… met parking have said I should have registered my car. They wrote:

“Other users of the car park must pay the appropriate tariff for the duration of their stay on site. Having checked our records, we confirm that your vehicle was not registered and as such you were not entitled to the free parking period, nor was a valid payment made for the duration of your stay. Therefore, we believe the charge was issued correctly and we are upholding it. We are confident there are sufficient signs at this location bringing the terms and conditions of parking to the attention of motorists and it remains the driver's responsibility to check the signs where they park and comply with the terms and conditions.

On this occasion, we are prepared to discount the charge to £20 subject to the charge being paid within 14 days”

    WHAT SHOULD I DO?

This means that they are running scared before they fold like a house of cards before the hearing fee has to be paid. You can pay them £20 or stand your ground and not pay them a penny.

Your choice. Some would say pay the £20.

But this isn't your thread.  This is a thread about a court claim. Leave it to the OP, please.

    Hi all

update - just finished the mediation and the lowest they came back with was £185 so looks like it’ll be going to court.

Fingers crossed they discontinue before then.

any advice on what I can do next? I’ve put together my defence shall I post it here?

    Thanks

I suspect you have already submitted your defence if you've had the useless mediation phone call! If you're referring to your WS, then why the rush? As it is 99% likely they are gong to discontinue anyway, around a month before any hearing date, you do not want to submit any WS before you get a chance to review theirs.

Slow down and just go with the flow!

In a panic I submit my defence super quick and only realised I couldn’t amend it after I submit it.

Should I forward the email above to DCBL too? Or wait for the mediation?

Just to remind us all, going forward, that the defence was as shown above. No keeper liability, Southgate Stansted. NTK shown on page one.

Can you show us the Particulars of Claim on the left of your claim form (cover your VRM).

    Here’s the claim form.

I went through my whole defence with the mediator, also brought up the fact it’s not relevant land and they can’t pursue the registered keeper and when she spoke with dcbl they said it is relevant land as it’s a private car park 🤷🏻‍♀️

Relevant land or not (it's not), the late delivery of the PCN is fatal to their claim against the keeper.
They will probably allow the case to be transferred to your local court then discontinue some time before the hearing, possibly without telling you.
Always remember to abide by Space Corps Directive 39436175880932/B:

I received a PCN from met parking services issued on 14.10.23 contravention date 12.09.23.
I’ve read so many of the threads and advice.
I wasn’t the driver and have never confirmed who the driver was. I appealed to met parking via email (first mistake) and also questioned the 14 days to registered keeper but all they sent back were photos from cctv

You didn't have to waste an hour on this phone call. I know the mediation letter says you should go through your defence but that's not what our Template Defence thread tells you to do at Mediation. Point 9 in the first 12 steps. Your phone call should have lasted two minutes flat! Never mind, no harm done.

This NTK wasn't served on time and wasn't worded for keeper liability and DCB Legal know that.

Read the NEWBIES thread about WS and evidence stage, as you will need to spell out the fact this is NTK non-POFA worded and not served in time, and thus incapable of 'keeper liability' (DCB Legal lied to the Mediator according to your report of it above).

The Particulars of Claim above also referenced the POFA when they must not. This is false.

    Thank you!
I know I didn’t need to waste time on the call but I thought let’s just see what happens 😅

it’s been transferred to my local court and dcbl have tried calling a few times! I actually went past today after landing at Stansted and went through the drive through, they told me the signs were updated end of last year. All of them now say pay to park.
