Identified as driver on Private Parking by NEXUS Group

Hi everyone, Not a new here.
He did naive appeal using google translate, as doesn't speak English (1-2 out of 10)
He have proof of all the attendance to the Gym.
Question 1: is there an easy APPEAL - NOT paying option? As he will not be up to lvl to mediate
My friend Received parking fine notice from Nexus group when parked next to Gym.
He goes there weekly. Numberplate to Reception Tablet device - allows to park for limited time.
One day he receives a letter "ticket" inviting to PAY.
He contacts them and says, - I was the driver, but your app did not worked. Photo attached to the message. Manager of the Gym - did not assist.

He have proof of all the attendance to the Gym.
Question 1: is there an easy APPEAL - NOT paying option? As he will not be up to lvl to mediate
Question 2: how many steps this will likely take?
He will be cancelling his membership based on this experience, as this is not the first time. the other day app crashed, and receptionist seen that. He did not had a phone to take a picture..

Group Nexus are BPA members so should cancel a parking charge notice for a minor typing error (one character wrong) or a reduced charge of £20 if two or more characters were typed in wrong.
Have Group Nexus responded to the appeal, and if so, have they offered a reduced payment. If they have not, a complaint should be made first to Group Nexus. If they fail to respond or fail to offer a reduced rate, then a complaint should be made to the BPA.
In any case, a complaint should be made to the owner of the gym and/ or the CEO, and the landowner if different, and the driver's MP.

Manager of the Gym is dealing with this NOW, and hopefully this conclude.But generally speaking -1. If driver identified himself is the process any different?2. If genuine parking error is there, or even letter sent to late, but the driver identified already himself would the process sway far of the described one in newbie?Like:
1. Check- PCN or NTK serve date is within 14 days
- PCN or NTK letter complies with the regulations applied
- Private parking company is not member of BPAssociation
3. Appeal to Parking company according to their appeal route
4. Appeal to POPLA5.

A driver can always be held liable by an unregulated private parking company if the driver's details are known to the PPC.
In certain circumstances, the vehicle keeper (whether registered keeper, day-to-day keeper, or hirer/lessee) may be liable if the site is relevant land, AND the PPC has fully complied with the PoFA 2012.
This is all explained in detail in the sticky Announcement for NEWBIES.
Plan A is always a complaint to the landowner and MP.
Plan B is an appeal to the PPC without revealing the driver's identity
Plan C is a second stage appeal (only) where the PPC is a BPA member
Plan D is to win in court
The general advice is, do not pay, do not ignore, do not reveal the driver's identity, complain to the landowner and the motorist's MP
Where a reduced charge is offered where a keying error has been made, then the motorists should of course consider whether it is worth doing. If a reduced charge should be offered, but hasn't, then complaints should be made first to the operator, then to their trade association.
I did ask you previously if GN had responded to your friend's appeal, and if so, was a reduced charge offered. Do you have an update from the friend about this, and about how they got on with their MP complaint please?
