My car was scrapped by the council.

    If they have offered £6000 then probably all you are going to get. The outstanding finance is irrelevant as has been said.

    it was stolen before i sent it to the garage it was stolen from my street (it had no insurance so i wasn’t driving it) , then the person who stole it crashed it , then i had dropped it at the garage to repair as it was just body work damage and not anything to do regarding the engine. I then was saving the money slowly to pay to the mechanic they had left it outside the garage , at this point the car did have insurance tax etc , i then received a letter from the council saying to come and collect the car etc ( the date that was on my letter was the 5th of october) I get there around mid september they tell me they have scrapped the car. I just want to know if I can take them to court for the full amount because they scrapped my car due to a typo on a letter. I just want the money the finance company are asking for and to be out of this stressful situation. as I don’t really want to be ruining my credit score with settling or anything like that . i’m just a young person who made a mistake and is now trying to amend this mistake

    If the council have admitted their mistake and offered compensation, then they only have to offer the value of the vehicle at the time. They are not responsible for the difference between that value and the amount you owed to the finance company.

    The court is unlikely to make them pay that difference as it would be betterment. I am assuming you didn't have any sort of gap insurance.

    How much finance is left on the car if you paid off the £6k?

    Still has to be insured while on the public highway. Finance agreement is also likely to specify that the vehicle remains insured at all times.

    You left it at the garage - inside the garage premises or sitting on the road outside the garage, or sitting on the road  a distance from the garage premises?

    How long was it sitting on the road before the council seized it.?

    Unless it was causing an obstruction normally  there would be a delay before they seized it. 

    If it was left for while without being moved and it had £5000 of body work damage on it it would certainly look as omit it had been abandoned. 

    The fact that the council are offering you £6000 is because of their error.  Without the error you would not get anything.

    But they will not pay the value of the car without £5000 of damage on it. They will pay the market value of the car , in the condition it was at the time.

    They have offered you the scrap value of the damaged car.

    The council will only pay the value of the car at the time they took it to be scrapped, not the amount left to pay on the finance, the outstanding finance doesn’t have anything to do with them, and the reason the car wasn’t worth its full value was due to the theft damage, which was not caused by the council, so they have no liability for this.
    if you had kept up the insurance they would have paid for the theft damage, but as you didn’t unfortunately that’s now down to you.

    if you had kept up the insurance they would have paid for the theft damage, but as you didn’t unfortunately that’s now down to you.
    Hiya , I was told they would pay the value of the car minus the damages on the car, I did not think it was it was going to be 6 grand as the car was worth a lot more ( obviously not brand new ) but I was still expecting around 10/15 grand
