£1 CCA Request

Hi there, I’ve recently sent a total of 6 CCA request letters each containing £1 postal orders. Lowell x 3, Cabot x 2 and Wescot x 1 

I’ve just received the following email from Lowell’s regarding 1 account : - 

Just to confirm that on 27/12/2024 we received your payment of £1.00 on your Lloyds Banking Group PLC account with Lowell reference *********. Your new balance is £3884.65.

I’ve checked on my app and it shows as a £1 payment to my account. 

Is this normal procedure?

    No it is not acceptable. There may be a standard letter of complaint somewhere in the stickies? how long since you previously paid?

    Would complaining about it acknowledge the debt and reset the statute barred clock?

    I’ve just started really 2 months ago on my own DMP paying monthly standing orders.

    if you have already started repaying the debt then that in itself is acknowledging it.  That doesn't take away from the fact that they have purposely misapplied the payment made and they need to correct that.

    No it is not.

    You need to make a complaint to Lowell about this, something along these lines:

    Dear Lowell,

    COMPLAINT

    On (insert date) I sent you a request for information under section 77/78 of the consumer credit act, in relation to the Lloyds Banking Group PLC account with Lowell reference ********* as is my right under the above act.

    For the avoidance of doubt, the statutory £1 payment is the fee for this service, as outlined in section 77 of the consumer credit act 1978, it is not to be allocated too, or treated as, a payment to this account.

    Unfortunately this fee has been credited as a payment, and you must reverse this mistake immediately, and use the £1 fee as originally intended.

    Please treat this as an official complaint, I understand you have 8 weeks in which to issue me a final response.

    I’m in a plan and all recently defaulted do I’m not concerned about the acknowledgement. My soul purpose is getting CCA replies from all six to see if any are unenforceable. 

    I await the other 5 replies of which 2 will be fro Lowell’s. 

    Does a template letter exist for a reply or should I contact via phone?
