I paid a parking ticket because they gave me a ccj which i didnt know about

Hi,

unfortunately i had to pay £300 to have a ccj looked into as i had no idea where it came from. i was then contacted by the people which issued the ccj and said if i paid the fine they would remove the ccj.

the reason i didnt know about the ccj is because they had sent it to an old address (allegedly).

i was then told i could claim the £300 back from the court (civil national business centre) to re open the ccj case because i had used the help with funds and now i am being told they cant refund the money. i have spent so much on this because i was scared and dont know what to do next. Please help me if you can!

i ended up signing a contract to pay the parking fine so, i think that is long gone but i hope it isnt. if there is any more information i can provide for you to help me out.

    Please read the NEWBIES FAQ Announcement, second post, the section about CCJ set asides, then come back with some more detail like date of the CCJ, when you paid it, who was the parking firm, which solicitors represented them, a bit about the parking event. That should help get the ball rolling. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Has the CCJ been wiped?

    Or just marked satisfied?

    Check the address on the VC5 for your vehicle - a common reason for this is that people move and update their driving licence details with DVLA but not their VC5s

    I had them write an agreement to wipe the CCJ. How can you see if it’s been agreed as satisfactory or wiped. Is there anything else I can do?

    Also my v5 was changed instantly so this was their mistake

    So why did you pay them?  You never had to pay this.  They ripped you off.

    Did you sign a Consent Order? What did it say?

    I am speaking on behalf of my partner as this is for them. the ccj was wiped, it was euro car parks. i parked during covid when the pubs has just opened and we were not allowed to go inside. so we had to tell the bar staff our registrations. in which they obviously didnt put my reg in. so received no real letters. but a ccj. it was a Tomlin order that i signed.

    Here is what was agrred:
    AND BY CONSENT IT IS ORDERED that: 1. The Judgment entered against the Defendant on (date) is hereby set aside. 2. All further proceedings in this Claim will be stayed except for the purposes of carrying out the terms of the schedule attached to this order. 3. Each party shall have liberty to apply to the court if the other party does not give effect to the terms set out in the attached schedule. 4. The hearing listed on (date) be vacated. 5. No order as to costs.

    £418 was paid to QDR Solicitors, this also cost £280 reopen in order to get the ccj set aside

    Ouch.

    So sad that they fooled your partner into accepting that rubbish order. None of that was needed and the PCNs did not have to be paid.

    The Defendant never had to agree to that Tomlin order but that aspect is water under the bridge. Can't change it as they signed it.

    Re the £303 wasted application fee and refusal to let the D apply for Help With Fees, the D should Google for the HMCTS Complaints Team email and file a formal complaint that the court has kept their money despite knowing that the N244 application was cancelled early so no work was involved and no hearing was even set, let alone happened. Why should the D who potentially qualifies for Help With Fees have nowhere to turn to cover that fee retrospectively under the circumstances?
