The first thing to do is check the Registered Keeper's address on the vehicle's Registration Document(V5c).
Is it correct, and more to the point, was it correct in October?2 -
yes all the documents are all up to date i have lived at the same address the last 13 years there is no reason for them not to have sent me a ntk1

Plan A is always a complaint from the keeper to the landowner and the keeper's MP.
You could try to appeal the charge using the Smart Parking appeal portal, if it will let you. If it won't, then you could appeal by post, sent first class from a Post Office counter and obtaining the all important free proof of posting receipt.
Start the appeal by stating that since the letter from DRP is the first thing the keeper has heard about the charge, you are treating DRP's letter as the notice to keeper.

If Smart refuse to accept it, complain to the BPA that yet again, one of their members has gone straight to debt collectors without first issuing a NTK. Do make the complaints to the landowner and MP first.

Smart parking had 7 months to issue a postal PCN to you, but clearly their letters went somewhere
Smart parking never comply with pofa so no 14 days deadline and no keeper lliability either, so no blabbing about who was driving or about the incident itself, keep stum
Put a complaint in to Smart parking using the link in the BPA AOS members list, on the right, confirming your name, address and VRM details and state that no postal notification has ever been received, so you cannot understand why a debt collector letter arrived
Ignore the powerless debt collectors
And remember, no blabbing about the driver or incident, just the total lack of previous paperwork2 -

So on the 21/12/2024 the keeper received a letter from drp about owing £170 for a unautharised park. As this letter is the first thing the keeper has heard of this charge I am treating DRP’s letter as the notice to keeper as you failed to send the keeper a NTK.
this is an appeal by the registered keeper - No driver details will be given. Please do NOT try the usual Group Nexus Trick of asking for driver details in order to get around the fact your NTK does not comply with POFA. As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw.

I would not appeal, ot yet, it's a complaint, as I clearly stated , that I would start with
Any other complaints can wait until Smart parking reply, although personally I would also follow plan A too, a complaint to the landowner or retail park management company or business , so 2 complaints for now
Do not try an appeal to Smart until they respond to the complaint is my strategy, but you can add that Grizebeck appeal into the complaint to Smart, a double whammy
You cannot complain to the BPA until Smart respond

Ok i will make the complaint and yes i live in England. I was going to make a complaint to the landowner but they put up a notice on there fb account saying " Don't bother complaining or asking them to do anything they wont" so i didn't see the point1

Then if the Smart parking site wont let you appeal as keeper, as mentioned by Fruitcake, add the pofa appeal into the complaint via the BPA AOS members link and do it that way, 2 birds, one stone1

Yep a complaint to Smart, threatening a report to the BPA.
I assume you searched and read all the other threads in the past 18 months where this happened, ALWAYS involving Smart and DRPlus?
Lots of threads to read. Do a search. I even linked several in one post on a thread and showed it to the Government this year!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
